The Migration Agents Regulations 2026 will take effect on 1 April 2026, replacing the Migration Agents Regulations 1998 before their planned expiration. The updated Regulations are designed to simplify, clarify, and modernise the regulatory system for registered migration agents (RMAs), while maintaining the core structure of the existing framework.

The new Regulations update and clarify important definitions, particularly those concerning employer–employee arrangements and the limited situations in which close family members may provide immigration assistance without being registered. They provide clearer guidance on when assistance from employers or relatives falls outside the definition of “immigration assistance” under the Migration Act 1958.

In addition, the revised framework enhances regulatory safeguards by broadening the concept of employment-related relationships. This aims to prevent agents who are suspended or barred from avoiding disciplinary measures by operating through alternative business arrangements. The Regulations also introduce updated requirements regarding the information published on the Register of Migration Agents, including clearer rules on how long disciplinary findings must remain publicly available and when they may be removed.

Former federal Labor MP Craig Thomson has been jailed for four years for his role in a multi-million dollar visa fraud scheme and fraudulently receiving COVID-era payments.

In handing down his sentence, Judge Robert Newlands SC told the Sydney District Court that Thomson took money from people looking for visas even though he was not a registered migration agent.

The court heard he acted as a middle man while those applying for a visa could have gone straight to a migration agent.

He charged visa applicants up to $50,000 to assist with their applications, regardless of their outcome.

Effective 31 December 2025, the Department of Home Affairs has ceased immigration operations at:

- the Australian Consulate-General in Dubai
- the Australian High Commission in Singapore
- the Australian Embassy in Washington DC.

These decisions affect the immigration functions in these locations only.

Ceasing immigration operations in these locations will not impact visa applicants, as visa applications are lodged via digital platforms. There is no need for clients to attend one of our overseas missions in person to lodge a visa application.

The Home Affairs website has been updated to reflect these changes. As is the case now, visa applications in these regions will continue to be processed anywhere in Home Affairs’ global immigration network.

"Review of the ART decision"

Applicants can apply to the Federal Circuit and Family Court of Australia (the Court) for judicial review of our decisions. The Court will consider whether we made a jurisdictional error. If you wish to apply for review, you must do so within 35 days of the date of our decision. If you require an extension of time, you must ask for it in the application and explain why. The Court will decide whether or not to grant an extension of time.

The Minister may substitute a more favourable decision.

The Minister has powers under the Migration Act 1958 to substitute our decision with a decision that is more favourable to the applicant. Generally, the Minister will only do so if there are compelling, compassionate or humanitarian considerations.
