The Migration Agents Regulations 2026 will take effect on 1 April 2026, replacing the Migration Agents Regulations 1998 before their planned expiration. The updated Regulations are designed to simplify, clarify, and modernise the regulatory system for registered migration agents (RMAs), while maintaining the core structure of the existing framework.
The new Regulations update and clarify important definitions, particularly those concerning employer–employee arrangements and the limited situations in which close family members may provide immigration assistance without being registered. They provide clearer guidance on when assistance from employers or relatives falls outside the definition of “immigration assistance” under the Migration Act 1958.
In addition, the revised framework enhances regulatory safeguards by broadening the concept of employment-related relationships. This aims to prevent agents who are suspended or barred from avoiding disciplinary measures by operating through alternative business arrangements. The Regulations also introduce updated requirements regarding the information published on the Register of Migration Agents, including clearer rules on how long disciplinary findings must remain publicly available and when they may be removed.
