Breach of Bail in New South Wales

When you are granted bail you have to sign an acknowledgment of the bail and its conditions before you will be released. By signing this you are agreeing to comply with all of the bail conditions. If you don't, it is called a breach of bail. You can breach a bail in two ways, either by breaching a condition of your bail or by failing to appear in accordance with your bail undertaking. A failure to comply with a bail condition is not an offence but it can lead to the bail being reconsidered by the court. Failing to appear in accordance with a bail acknowledgment is a criminal offence. In New South Wales the law on Bail is contained in the Bail Act.

Once a voluntary scheme, Orders in have, since 1 February 2015, became mandatory for the courts, subject to very few exemptions, when sentencing those convicted of particular drink driving offences. The orders require the driver to install and use an interlock device in order to resume driving earlier than would otherwise be the case.

Tenant rights and obligations in respect of the payment of are generally quite straightforward. Prior to moving into the property the tenant will most likely have to pay to the landlord a bond deposit to be held until the tenancy has ended. The maximum amount of bond the landlord can charge is 4 weeks rent.

The landlord must lodge the bond with Fair Trading . Once it has been lodged, you will receive a lodgment notice confirming they have received the bond. If you do not receive a lodgment notice, you can contact Fair Trading NSW to confirm they received your bond from the landlord.

An AVO in New South Wales is called an Apprehended Domestic Violence Order (ADVO) if you and the person against whom you are seeking the order have been or are in a domestic relationship.

This means:
* being married or in a de facto relationship
* living at the same premises (including in a residential care facility)
* being in an intimate relationship
* being related (including as kin or extended family if you are an Aboriginal or Torres Strait Islander person).

Otherwise, the AVO is called an Apprehended Personal Violence Order (APVO). In an APVO the court will order you and the defendant to go to mediation unless there is good reason not to.
