Although, in Queensland, it is not actually"legal" to record a telephone discussion with someone on your phone (eg with a call record app), particularly without the other person's knowledge and consent, a Queensland Court has, nevertheless, permitted such a recording into evidence.

In the case of R v Wolfe in Queensland, a bid to exclude a video recording made without the suspect's permission has been dismissed by the District Court in Brisbane.

The Judge ruled that the recording should not be excluded as evidence because it contained statements that could be seen as admissions by the defendant.

The Court was told that the recording was made by the suspect's son, Peter, during a phone call with the complainant, Peter's sister Rebecca. Rebecca recorded the conversation on her phone and sent it to Peter, who uploaded it to evidence.com.

The Defence argued that the recording should be excluded because it was unreliable and Peter was acting as an agent of the police.

However, the Crown argued that the recording was highly probative and the defendant's statements were voluntary.

The Judge agreed with the Crown and ruled that the recording should not be excluded.

The Judge also determined that if the police can obtain a copy of the recording from Rebecca's phone, it should be admitted as evidence, and if they cannot, the copy from evidence.com should also be admitted.

Have you ever been subjected to constant babble or rambling on from a dear friend or loved one? Are you sick of saying "please get to the point" or "what are you trying to tell me?" Having had a relationship with 2 hairdressers, I know what this is like (no disrespect intended ladies 🤗).
