Our Senior Associate and personal injury lawyer, Candice Heisler this week provided some commentary on how the QLD Government’s refusal to provide condoms to prison inmates could lead to the Government facing legal action for negligence.

“The government could be found liable if a prisoner contracted a s*xually transmitted infection while in their custody.

If you’re going to pursue a negligence claim, we would ordinarily need to prove that there was a risk of injury that’s foreseeable and that [the government] has a duty of care [to a prisoner].

It’s well known that unsafe s*x leads to s*xually transmitted infections and we’re talking about a densely populated environment of high-risk individuals … condoms would be the bare minimum that they ought to provide to reduce that risk.”

Government warned it could be found liable over contraction of s*xually transmitted diseases in only state still opposing distribution
