Buying off-the-plan is a choice that many investors and home buyers make. Many will do this with the “perceived” safety net of a pre-approved loan.

However, along with a number of general risks associated with purchasing off-the-plan, there are additional risks directly resulting from the property, certain market trends, and the interest rate rises, particularly when relying on a pre-approved loan.

It’s not uncommon for partners/spouses to have identical Wills, particularly when it’s a simple Will.

Identical Wills are called Mirror Wills.

On other occasions, partners/spouses may consider making a Will each, which forms a binding contract between them. This one’s called a Mutual Will.

If you’ve bought a property in the past, you may be familiar with Section 32 disclosure statements. This is where a vendor (the person selling a property) must provide you with information such as council rates, easements and planning schemes.

But these aren’t the only facts they must disclose.

The law also requires the vendor to disclose any ‘material facts’ relevant to the property.
