From 1 September 2026, changes in NSW allow you to specifically authorise your Enduring Guardian to make decisions about the use of restrictive practices if you lose the capacity to make those decisions yourself.

This can be particularly important when it comes to aged care.

Restrictive practices can include measures such as restricting a person’s movement or access to certain areas, a roll bar to prevent someone rolling out of bed, using restraints, keeping someone separate from others, or using medication to manage behaviour.

While the idea of these practices may understandably be confronting, there may be circumstances in aged care where a facility considers them necessary to protect the person receiving care or others around them.

The changes mean you can give the person you have chosen and trust as your Enduring Guardian the authority to consent to, or withhold consent to, restrictive practices on your behalf.

Importantly, giving your Enduring Guardian this authority doesn’t mean restrictive practices will automatically be used. It gives your guardian the ability to make that decision if the situation arises.

If your Enduring Guardianship documents were prepared before these changes, they may not contain this authority.

If you have an Enduring Guardian, particularly if you are planning for future aged care, it may be worth reviewing your documents to make sure they reflect your wishes.

Talk to Farrell Goode about whether your Enduring Guardianship arrangements need updating.

Farmers – this one may be worth a loFarmers – this one may be worth a look. 🚜📡

Round 3 of the Australian Government’s On Farm Connectivity Program is now open, helping eligible primary producers improve digital connectivity and adopt new technology on farm.

The program offers a rebate of up to $20,000 (excluding GST), covering up to 50% of the eligible purchase price of equipment. Eligible equipment includes technology relating to connectivity, environmental monitoring, farm management, remote automation and control.

Importantly, primary producers access the program through an Approved Supplier, rather than applying for the rebate directly. Eligibility requirements also apply, including income and ABN requirements.

Applications close 5pm AEDT, Thursday 15 October 2026, and the program is demand-driven, meaning funding may be exhausted or oversubscribed.

If improving connectivity or technology on your farm has been on the to-do list, it could be worth checking whether you’re eligible.

Jason, Mitch, Adam, Jack and Tom were all in Wagga last week for the South West Slopes Law Society CPD Day at The Gardens.

One of the key discussions explored de facto relationships in the context of succession and related matters, including the evidence that may be needed to prove – or disprove – the existence of a de facto relationship.

Retired Supreme Court Judge the Honourable Philip Hallen SC was one of the keynote speakers, bringing plenty of experience, insight and interaction to the session. The CPD program also covered succession, family law, AI and mediation.

A very informative day, a great opportunity to catch up with other legal professionals, and a lovely setting at The Gardens in Wagga Wagga.

Thanks to the South West Slopes Law Society for hosting such a worthwhile event.

The Farrell Goode office was well and truly showing its colours for the Rugby League finals last weekend.

A huge congratulations to the League Tag team on their Grand Final win! 🏆👏

It wasn’t to be for Reserve Grade or First Grade on the day, but what a fantastic achievement to have so many Temora Dragons Rugby League Club teams make it all the way to the Grand Final.

Well done to all the players, coaches, volunteers and supporters on a great season. Plenty for the Temora community to be proud of! 💙❤️

What happens when someone ignores a family law order?

From today (21 September 2026), a new National Enforcement List will provide a streamlined process for enforcing parenting, property and financial orders.

It may assist when a former partner refuses to:

➡️ Transfer property
➡️ Sign required documents
➡️ Pay money as ordered
➡️ Comply with parenting or financial orders

A court order should not be ignored. If someone is failing to meet their obligations, it is important to seek legal advice about your enforcement options.

Contact the family law team at Farrell Goode to discuss your circumstances.

Some things really are best left to the experts!
Writing your own will might seem straightforward, but small mistakes can have much bigger consequences than you expect.

When it comes to something as important as your wishes and your estate, it pays to get it right.

DIY is probably better saved for the Bunnings aisle. 🔨

When you're dealing with family, it can feel overly formal to put an agreement in writing. After all, you trust each other.

But circumstances change. Memories differ. Relationships change. And what one person understood the agreement to mean may be very different from what someone else remembers years later.

A recent court battle involving a woman who paid more than $550,000 over 11 years towards a property owned by her parents is a powerful example. She believed the arrangement meant the property would eventually become hers. Her parents said the payments were rent.

The dispute ultimately ended up in court.

Whether it's a family loan, property arrangement, business agreement or succession plan, documenting what everyone has agreed to can help protect both your interests and your relationships.

Getting it in writing isn't about not trusting someone. It's about making sure everyone is on the same page.

If there's something important at stake, speak to us about putting the right agreement in place.
