Lawfully Explained is a new initiative by the Law Society of NSW to provide free information to the public about a wide range of legal topics in a way that people can understand. Lawfully Explained has articles, podcasts and videos that deal with a wide range of legal topics. One of the new podcasts by Lawfully Explained (accessible via the link below), explains why engaging a good estate planning lawyer to draft a Will is so important and explains some of the reasons why claims may be made. The podcast is only 31 minutes and is well worth listening to if you are considering whether you need to make or change your Will or if your current Will is appropriate. Please do not hesitate to contact Myall Coast Legal, if you require assistance with your estate planning.

Collaborative Law is not just available for separation. Where there is conflict, the collaborative law model is also now being applied to assist parties to finalise estate planning and claims.

Dragging a divorce through the courts can be painful and expensive for all involved. What if there was an alternative that saved both money and heartache?

🚗 5KM TRAVEL RULE EXPLAINED 🚗

As of tomorrow, a new 5km travel rule applies. It’s the same as the 10km rule, you just can’t go as far.

🏡 Fundamentally, you may only leave your home if you have a reasonable excuse.

🍌 It is a reasonable excuse to leave your home to shop for essential goods and services. You can only travel within your local government area or, if you must travel to another LGA, within 5km of your home.

YOU CAN TRAVEL ANYWHERE IN YOUR OWN LGA IF IT IS NECESSARY.

🚗 If you cannot buy the essential goods or services within your LGA, you are allowed to travel to another local government area, but no further than 5km from your home. And you must be able to explain why the travel is necessary.

🏃🏽‍♀️ For exercise, you must stay within your local government area or within 5km of your home.

🙏🏼 So, if you can buy your groceries closer to home, exercise closer to home or avoid travel altogether, please do so.

🧑‍🍳 The 5km/LGA travel rule applies to essential shopping and exercise only. It does not apply to other reasonable excuses to leave your home, such as employment, caring for another person, childcare, education, accessing government services etc.

🏖 The 5km/LGA travel rule applies to all of NSW.

🦠 The spirit of the rules are clear - to stop all unnecessary travel to reduce risk to yourselves and our community.

🦅 The 5km is as the crow flies - here’s a handy tool to check: https://2kmfromhome.com/5km?fbclid=IwAR2bbnRwULXGlIcXPB6vYIunMwv3QMx1UzJRpBbQ18CiEW1giXp9j71y-JE

⁉️ These rules are clearly more designed with Sydney in mind given the distances many of us have to travel for groceries and essential services. But it’s what we’ve got to work with, so we’ll all just do our best.

📞 If you have particular circumstances which may necessitate travel, and you’d like confirmation before you set off, please contact Service NSW 13 77 88 for detailed and accurate advice.

❤️ Don’t forget, it’s important to look after yourself. Stay connected with friends and family via phone or zoom, check-in with others, switch off and get some exercise.

👋🏼 Finally, it’s okay not to feel okay. And there’s always someone to talk to – call a friend, your doctor, or a helpline like Lifeline on 13 11 14.

🙏🏼. Final final note - thank you for keeping your comments constructive and kind. These are challenging and confusing times for everyone, so let’s make sure we keep being kind to one another.

🚨7 DAY LOCKDOWN IN THE HUNTER 🚨

Officially, the Hunter’s 7 day lockdown does not apply to townships in the MidCoast Council area (north of the Karuah Bridge).

This means Tea Gardens, Hawks Nest, Pindimar, Bundabah, North Arm Cove and Limeburners Creek are NOT within the lockdown area.

The 7 day lockdown includes the Local Government Areas of Port Stephens, Dungog, Maitland, Newcastle, Lake Macquarie, Cessnock, Singleton, Muswellbrook.

If you have visited any of these LGA’s since 31 July, the same lockdown rules apply to you.

Given the high mobility between our beautiful northern townships and the Port Stephens LGA, I urge everyone to follow the lockdown rules to help keep our community safe.

We came across an article in the Conversation today that cites statistics indicating that only 25% of older Australians have Advance Care Plans. We congratulate our clients that are part of this 25% and ensure that guardians and family members are prepared for the worst. For those that still need get their affairs in order, it is now more important than ever that you properly communicate values and preferences in relation to health care and treatment to family members and ensure you have appropriate formal documentation in place. For those that need our assistance, please do not hesitate to contact us.

If you became suddenly unwell, would your family or health team know your wishes? Here's why advance care planning should be part of Australia's strategic response to COVID-19.
