NSWYL Workplace & Safety Law Committee The Workplace and Safety Law Committee provides a diverse forum for young lawyers and students with an interest in employment and industrial law.

The Workplace and Safety Law Committee provides a forum for young lawyers and students with an interest in employment and industrial law. As well as discussing new cases and legislative changes, raising public awareness and pushing law reform, we coordinate a number of exciting networking and professional opportunities, including the prestigious McCallum Medal. The Workplace and Safety Law Committ

ee is made up of a diverse group of young lawyers and students with an interest in discussing and shaping changes in workplace and safety law. Our members include lawyers in private practice, trade unions, government and in-house, as well as associates, tipstaffs and law students. We have more than 300 members and regularly organise a range of social and networking events, so becoming involved with our Committee is a great opportunity for you to meet other young lawyers in your specialist area, acquire skills and develop your career. Good morning everyone

Please join us tonight for our monthly committee meeting kicking off at 6.00pm on Zoom. The topic for this evening's meeting is around adverse action and what it means to be “able to” make a complaint or inquiry in relation to employment.

Since Shea v TRUenergy Services Pty Ltd (No 6) [2014] FCA 271, the Federal Courts have grappled with the words “able to” contained in 341(1)(c)(ii) of the FW Act.

In 2020, differently constituted Full Federal Court benches gave conflicting views about the proper construction of those words in PIA Mortgage Services Pty Ltd v King [2020] FCAFC 15 and Cummins South Pacific Pty Ltd v Keenan [2020] FCAFC 204.

Barristers David Chin SC and Miles Foran from 5 Wentworth will explore the different views and their impact on adverse action litigation.

We're getting close to our first in person event on Thursday night from 6.00pm.

We have a fabulous line up of panel members that will consist of a range of experts from across the legal profession. The panellists will explore the various career opportunities available to early career lawyers interested in workplace relations and safety law.
