NSW Strata Managers: Can an Owners Corporation refuse a builder access to rectify defects?

A significant NSW Court of Appeal decision has clarified that builders have no automatic right to return and fix defects, even where they offer to do so at no cost. The ruling provides valuable guidance on Owners Corporation rights, mitigation of loss, statutory warranties, and the burden of proof in defect disputes.
