Judgment just in: Curtis v Curtis [2024] NSWCA 136

The Court of Appeal has allowed an appeal from a decision of the NSW Supreme Court which granted family provision orders for two grandchildren over the deceased estate of their grandfather. The Court held that the trial judge failed to address material evidence and submissions which pointed against the grandchildren’s account that they were dependent on the deceased. At times, conflicting accounts were simultaneously accepted by the trial judge without an attempt to resolve those apparent conflicts. The Court held that the evidence could not justify a conclusion that there were factors warranting an application, and set aside the orders.

What a terrible decision by the Eels. James Hardie products have caused the death of thousands of Australians over the last 60 years. They will cause the death of thousands more in the future. James Hardie continued to use asbestos for decades after they knew it was deadly and tried to flee the country to avoid paying compensation. To this day they do nothing to warn people about the dangers of their products that remain in almost every house built between 1960 and 1983.

The Parramatta Eels' jerseys from next season onwards will feature a throwback to the club's most successful era, but the return of James Hardie as a lead sponsor isn't a move that has been celebrated by everyone.
