A cautionary warning about AI 🤖 in our legal system.
As a legal profession, we are becoming increasingly concerned with the use of AI by clients and other parties to provide legal 'advice', to draft emails and legal documents, etc.
Here is a brief snapshot about the dangers of AI in the legal system.
1. AI robots do not hold law degrees, practising certificates, or insurance - you are simply not protected if the AI robot gets it wrong (when it comes to legal matters, the starting point should be that an AI robot will not provide you with accurate advice);
2. An AI robot cannot replace the critical thinking of a human being (a lawyer);
3. AI robots can apply the wrong law (or even completely apply and refer to made up law (this has happened many times!);
4. AI robots will never be across all the facts of your matter; lawyers are specifically trained to ask the necessary questions and to obtain the salient facts from clients, before delivering tailored advice. The AI robot will base its 'advice' on the facts you share (which can skew any information or 'advice' you receive from the AI robot);
5. Your relationship with your lawyer is confidential and subject to professional legal privilege - an AI robot does not have the same ethical obligations to you.
If you use AI in any way in your legal matter, please disclose it to your lawyer.
Clients will often say AI assisted with drafting their instructions, etc, "to make it easier to read for my lawyer".
Each time I have ever received AI generated instructions, it has unfortunately not made my job easier. In fact, it has made the instructions convoluted, unclear, and more confusing (which invariably results in an increase in legal costs).
Please trust yourself and draft your instructions in your own words - we want to hear and read your authentic voice. If I am helping a client in a domestic violence matter for example, I want to know exactly how my client felt and their exact experience (not a suppression of their voice and experiences through a robot).
I want to hear your human voice. Your experience as a human matters.
Keeping humanity in the legal system has never been so important.
