As the year draws to a close, we would like to extend our warmest wishes to you and your loved ones for a very Merry Christmas and a joyful holiday season.

2025 has been a rewarding and significant year for Albert Arthur Lawyers. We are proud to share several key milestones, including our relocation to a new office, the continued growth of our team, recognition as a Finalist for Partner of the Year, and the honour of receiving the Special Counsel of the Year award.

We were also grateful for the opportunity to participate in the Refugee Immigration through Education with SkillPath, supporting meaningful pathways through education. In addition, this year marked an important expansion of our practice, with our partner becoming a New Zealand Immigration Adviser, enabling us to assist clients with both Australian and New Zealand immigration matters.

Above all, we sincerely thank our clients for your continued trust and support. It has been a privilege to assist individuals, families, and businesses throughout the year, and we look forward to continuing to support you with care and expertise into 2026.

4️⃣ Tests before 13 Sept 2025 → single sitting only

Tribunal Remits Protection Visa Refusal Without Hearing, A Win for Integrity and the Rule of Law 🧐

In May, the Administrative Review Tribunal (ART) remitted a protection visa refusal, and did so without the need for a hearing. Behind this quiet win was a complicated story, one that highlights the serious risks of unregistered agents and the value of proper legal support.

👉Our client initially sought help from unregistered immigration agent who submitted false claims to the Department of Home Affairs, without his full knowledge or understanding of what had been said on his behalf.

👉The result was a protection visa refusal and a case clouded by misinformation and misrepresentation.

🙌When he came to Albert Arthur Lawyers, we emphasised that we must not continue with the false claims initially submitted. Instead, we did what the law requires:

✅ We rectified the false claims with a full, honest admission of the past mistakes.
✅ We submitted clear and detailed evidence of his genuine and ongoing fear of return.
✅ We stayed within the bounds of the law. Nothing fancy, just solid and rule-based legal work.

And it worked.

The Tribunal recognised what protection law is really about, not punishing past errors, but assessing current risk. Despite the previous wrongdoing, the Tribunal accepted that this applicant genuinely fears persecution and is deserving of Australia’s protection.

This outcome is a reminder of three key lessons:

🔹 Be extremely cautious with unregistered agents. They can do real damage.
🔹 It is never too late to put things right, if you act with honesty and follow the law.
🔹 And most importantly, proper legal representation matters.
