Positive outcomes achieved this week for our clients at K & D Lawyers.

✅ Successful ART outcome for a Subclass 482 visa applicant involving complex PIC 4020 issues for not disclosing offences. The Tribunal set aside the refusal decision and remitted the matter back to the Department for reconsideration 🇮🇪

✅ Medical Treatment (Subclass 602) visa granted for a client who had a visa cancelled. This outcome allows the client to remain lawfully in Australia and continue receiving necessary treatment and support 🇮🇪

✅ Successful waiver of a “No Further Stay” condition for our client from Lebanon, allowing them to pursue further visa options onshore following significant changes in circumstances and ongoing instability affecting the region 🇱🇧

✅ Permanent Partner visa granted through the Family Violence provisions, allowing our client to continue their permanent residency pathway despite the breakdown of the relationship due to family violence circumstances 🏴󠁧󠁢󠁥󠁮󠁧󠁿

Every case is different, but these outcomes highlight the importance of detailed preparation, strong evidence and strategic submissions.

Happy Friday!

We are pleased to announce a successful Ministerial Intervention outcome for two of our clients.

The Assistant Minister for Immigration considered the request and exercised discretion to substitute the Tribunal decision with a more favourable outcome, resulting in the grant of a Visitor (Substituted subclass 600) visa.

Ministerial Intervention requests are complex and highly discretionary, and outcomes like this highlight the importance of preparing strong submissions supported by clear evidence and compassionate circumstances.

If you or someone you know is facing a visa refusal, Tribunal decision, or is considering Ministerial Intervention, feel free to contact our office for advice.

Global Talent visa cancellation overturned!

The Administrative Review Tribunal has set aside the cancellation of our client’s Subclass 858 (Global Talent) visa and substituted a decision not to cancel it.

🟢 The visa was originally cancelled under s 109(1) of the Migration Act 1958 (Cth) on the basis of an alleged breach of s 103 – bogus document.

🟢 However, the Tribunal, after considering the evidence and the prescribed circumstances made a decision in their favour.

SUCCESSFUL STUDENT VISA APPEAL! 🎉

The Administrative Review Tribunal has remitted our clients application for a Subclass 500 (Student) visa for reconsideration — with a key determination:

✅ The applicant meets Public Interest Criterion 4013 under clause 500.217 of Schedule 2 to the Migration Regulations.

📌 What is PIC 4013?
PIC 4013 applies to people whose visas have been refused or cancelled on certain grounds. It usually prevents them from being granted a further visa — unless a waiver is granted.

How do you get it waived?
A waiver can be approved if you can demonstrate:

✅Compelling circumstances affecting Australia's interests, or

✅ Compelling and compassionate circumstances impacting an Australian citizen, permanent resident, or eligible NZ citizen.

In this case, we successfully showed that our client met those criteria
