Important updates regarding the process for applying for permission to work for more than six months under a working holiday visa which may benefit your employees as well as your business:

1. If You Have Already Submitted a Request Before the Six-Month Period Has Passed
If you have already submitted a request for permission to work longer than six months with the same employer, you may continue working for that employer while you await a written decision. Please note that due to the high volume of requests, the department is unable to send individual confirmations of receipt of your request.

2. For Those Awaiting a Written Outcome
If you are still waiting for a written outcome and your employer has questions, they can refer to Department’s website here for confirmation that you are allowed to continue working for them until a decision has been made.

3. If Your Request Was Submitted After the Six-Month Period
If you submit your request for permission to work beyond six months after the initial six-month period has passed, you must cease working until you receive the outcome of your request.

NEWS FOR 482 (Skill Shortage) VISA HOLDERS AND APPLICANTS

TSMIT will increase from $53,900 to $70,000 on 1 July 2023.

New nominations lodged ON or AFTER that date will be required to meet the new TSMIT of $70,000 or the annual market salary rate, whichever is higher.

Applications lodged BEFORE 1 July 2023 will not be affected.

Expanded pathways to permanent residence
By the end of 2023, the Temporary Residence Transition (TRT) stream of the Employer Nomination Scheme SC 186 will be amended.
• All Temporary Skill Shortage (TSS) SC 482 visa holders will be eligible for ENS visas sponsored by their employers.
• Applicants will need to continue to work in the occupation nominated for their TSS visa(s).
• Sponsored visa holders will be eligible for ENS TRT after two years (down from three years) of sponsorship on a TSS by their employer.
• Applicants will need to meet all other nomination and visa requirements for the TRT stream of the Employer Nomination Scheme visa.
• The limit on Short Term stream TSS visa applications that can be made onshore has also been removed in the interim.

International Student Visa Holder? Listen up!

Changes have just been announced for International Student Visas which will take effect from 1st July 2023.

The key changes include the following:

Additional two years for 485 Post Study Work stream visas (certain degrees only)

Former international students in Australia who have completed a degree in Australia may access extended subclass 485 visas from 1 July 2023

You MUST have studied a course in health, teaching, engineering and agricultural fields and have an occupation in one of those fields

Visa period changes:
• 4 years for select Bachelor Degrees
• 5 years for select Masters degrees
• 6 years for all Doctoral degrees

This applies to those who hold the 485 visa on 1 July 2023 or apply for the 485 visa from 1 July 2023. For those who would be eligible but their current 485 visa expires before the commencement on 1 July 2023, they will be eligible to apply for a 408 visa in the interim.

Student visa holder working hours will be up to 48 hours per fortnight

408 Covid-19 stream visas available for 2 years

Work restrictions for student visa holders

From 1 July, work restrictions for student visa holders will be re-introduced.

Student visa work restrictions were relaxed throughout the pandemic, and completely removed in January 2022 to allow primary and secondary student visa holders to work over their normal limit of 40 hours per fortnight to address workforce shortages. This will end on 30 June 2023.

From 1 July 2023, work restrictions for student visa holders will be re-introduced and capped at the increased rate of 48 hours per fortnight. This ensures that student visa holders are able to focus on obtaining a quality Australian education and qualification, while remaining able to support themselves financially, gain valuable work experience, and contribute to Australia’s workforce needs.

Streamlined requirements for temporary visa applicants in Australia

Temporary visa applicants in Australia will not be required to undertake medical examinations and chest x-rays, based on their nationality, previous residence and proposed length of stay, in order to meet the health requirement.

Temporary visa applicants in Australia will still be required to undertake relevant medical examinations and/or chest x-rays if they:

- have applied for a medical treatment, temporary protection or a provisional visa
- expect to incur medical costs or require medical treatment
- are intending to work as (or study to be) a doctor, dentist, nurse or paramedic
- will enter a hospital, aged or disability care facility (if higher tuberculosis risk)
- are pregnant and intending to have the baby in Australia
- will work or train at an Australian childcare centre
- are aged over 75 years (if applying for a visitor visa)
- have had previous household contact with tuberculosis or
- are requested to do so by the Department.

If you have already made a health examination appointment with Bupa Medical Visa Services and have not yet attended it, your appointment may be cancelled and refunded. Bupa will contact you via SMS to advise you of this. Do not contact Bupa to cancel your appointment yourself. If you are not advised that your appointment has been cancelled, you should attend if possible.

This arrangement applies to applicants for the following visa subclasses, and only if you are already in Australia:

401 - Temporary Work (Long Stay Activity)
403 - Temporary Work International Relations
405 - Investor Retirement
407 - Training
408 - Temporary Activity
410 - Retirement
417 and 462 - Working Holiday
461 - New Zealand Citizen Family Relationship
476 - Skilled Recognised Graduate
482 - Temporary Skill Shortage
485 - Temporary Graduate
500 - Student
590 - Student Guardian
600 - Visitor
870 - Sponsored Parent (Temporary)
995 - Diplomatic (Temporary)

This is temporary measure and applies to all eligible temporary visa applications currently with the Department and new applications made in Australia. The Government will review these arrangements in early 2023.

Travelling Offshore on a Bridging Visa B

Please be advised that while Bridging Visa B (BVB) applications continue to be processed, BVB holders will be denied entry to Australia until travel restrictions are lifted, unless an exemption applies.

If you have a need to travel please contact us prior to making any travel arrangements to determine whether you hold a visa that will allow re-entry or whether you meet requirements for a travel exemption.

Changes to Skilled Migration

The Department of Home Affairs has lifted the section 48 bar for three skilled migration visas to minimise the impact of COVID-19 on onshore applicants prevented from leaving Australia due to travel restrictions.

The federal government has amended its migration regulations to allow those onshore to lodge applications for select skilled visa subclasses, which include:

Subclass 491 - Skilled Work Regional (Provisional) visa
Subclass 494 - Skilled Employer Sponsored Regional (Provisional) visa
Subclass 190 - Skilled Nominated visa

NSW ANNOUNCES QUARANTINE FREE TRAVEL – THE FACTS

There has been much talk and excitement following the announcement today, that from 1 November 2021 NSW would allow quarantine free travel for those who are fully vaccinated, but as always the devil is in the detail and some of the statements made are misleading, causing confusion and giving false hope to potential travellers.

Dominic Perrottet is quoted as saying “’Those people, returning Australians, tourists, who want to come back, who want to visit Australia, who want to come into Sydney, Hotel Quarantine will be a thing of the past” that “For double vaccinated people right around the world, Sydney, NSW is open for business” and “We are opening Sydney and NSW to the world, and that date will come in on November 1st”.

What this announcement failed to highlight was that permission to board an international flight and clear immigration is still being dictated by federal legislation and the biosecurity act which requires a travel exemption if you are not an Australian Citizen or permanent resident.

To date NO CONFIRMED CHANGES have been announced to the current travel exemption system.

Scott Morrison indicated in his press conference today that the NSW announcement does not include visa holders such as students or temporary residents but indicated they are looking to extend the definition of immediate family to include parents.
