NSW Is Cracking Down on Underquoting
If you're selling in Penrith, this one's important.
NSW Fair Trading is strengthening enforcement against underquoting practices to improve transparency in the property market. Agents and vendors must now ensure all pricing representations are accurate and supported by evidence. Any misleading or unrealistic price indications may lead to substantial penalties and could ultimately delay or compromise a sale.
In plain English β if the price guide on your property doesn't reflect what you're actually willing to accept, your agent could be in breach of the law. And that can create complications for your sale.
As a seller, here's what this means for you practically:
π Make sure you and your agent are aligned on a realistic, evidence-based price guide before the property is listed
π Keep records of how your asking price was determined
π Understand that an underselling strategy designed to generate competition can create legal risk if it crosses into misleading territory
Getting the legal side of your sale right from day one, including your contract, your disclosures, and your pricing approach.
Before your home goes to market, pause and ask us first.
