In many family law matters, parties are expected to make a genuine effort to resolve the dispute before going to Court.

In parenting matters, this usually means attending family dispute resolution unless an exemption applies, such as family violence, urgency, child safety concerns, or another valid reason.

In property matters, pre-action procedures generally require parties to exchange disclosure, set out their position and attempt to resolve the dispute before filing proceedings.
