BREAKING: Australia Activates Section 84B – Visa Holders May Be Stopped from Entering the Country

The Australian Government has recently activated Section 84B of the Migration Act, giving the government new powers to temporarily stop certain visa holders from entering Australia — even if their visa has already been granted. Here’s what visa holders, international students, and migrants should know:

- Visa approval does NOT always guarantee entry
Even if your visa is granted, the government can temporarily pause the arrival of certain groups of travellers.

- Government can control arrivals
Under Section 84B, the Minister can issue an “Arrival Control Determination” to stop specific visa subclasses, traveller groups, or nationalities from entering Australia for a period of time.

- Airlines must comply
Airlines may refuse boarding to passengers affected by these determinations.

- Temporary measure
These powers may be used in situations such as:
• Public health emergencies
• Border management concerns
• National security issues
• Sudden migration pressure

As we approach the final quarter of the 2025–26 program year, the Tasmanian Skilled Migration State Nomination Program has released an important update regarding invitation rounds.

Skilled Nominated visa (subclass 190)
•Invitations are temporarily paused for ROIs without a Gold Pass.
•ROI submissions can still be lodged.
•Green Pass ROIs will continue to receive invitations within 6 months of submission.
•However, state nomination may not occur this program year if all places are filled.

Skilled Work Regional (Provisional) visa (subclass 491)
•Invitations will continue for all pass colours.
•The number of invitations will be reduced due to limited remaining places.
•Tasmania has received very strong interest in the program this year.
•Most of the state nomination places have already been used.

Important Update: Training Visa (Subclass 407) – New Sponsorship Rules from 11 March 2026!

The Australian Government has introduced significant changes to the application process for the Training Visa Subclass 407 under the Migration Amendment (Training Visas—Sponsorship Requirements) Regulations 2026. These changes came into effect 11 March 2026 and affect how sponsorship and visa applications must be lodged.

BEFORE 11 March 2026
Applicants and sponsors had flexibility in the lodgement process:
✔Sponsorship application
✔Training nomination application
✔ Visa application
- All three applications could be lodged at the same time.
- The visa could still be granted only after approvals, but applicants could secure a bridging visa and get into the processing queue earlier.

AFTER 11 March 2026 (New Rule)
A sequential approval process now applies.
Before lodging the visa application:
1️⃣ The organisation must already be an approved Temporary Activities Sponsor
2️⃣ The training nomination must be approved (if the sponsor is not a Commonwealth agency)
3️⃣ Only then can the Subclass 407 visa application be lodged.

Key Impacts:
• Concurrent lodgement is no longer allowed.
• Visa applications lodged without prior approvals will be invalid
• Applicants cannot obtain a bridging visa unless a valid visa application is lodged.
• Longer planning timelines may be required for sponsors and trainees.

Why the Government Made This Change:
The update aims to strengthen program integrity and ensure the visa is used for genuine occupational training rather than as a pathway to extend stay in Australia.

Plan early and ensure sponsorship and nomination approvals are secured before preparing the visa application.

- Australian Consulate-General in Dubai
- Australian High Commission in Singapore
- Australian Embassy in Washington DC

These changes apply only to immigration functions at the above locations.
- No impact on visa applicants — all visa applications are lodged online via digital platforms.
- No requirement to attend overseas missions in person to lodge visa applications.
- Visa applications from these regions will continue to be processed through Home Affairs’ global immigration network.

NSW Skilled Work Regional Visa (Subclass 491) – Key Update (2025–26)

👉PROGRAM OPENING:
NSW has opened nomination applications for the Skilled Work Regional visa (subclass 491) under:
- Pathway 1 – Work in Regional NSW
- Pathway 3 – Regional NSW Graduate
This applies to the 2025–26 skilled migration program year.

👉PATHWAY 1 – Work in Regional NSW
Eligible occupations:
- All occupations eligible for the subclass 491 visa can apply under this pathway.

Employment requirement:
- Applicant must be currently working in their nominated or closely related occupation.
- Must have worked continuously for at least 6 months with one employer.
- Employer must be based in a designated regional area of NSW.

Salary requirement:
- Must be paid at least:
o TSMIT (Temporary Skilled Migration Income Threshold) or
o CSIT (Core Skills Income Threshold)
o Salary must be met at the time of application.

Salary concession:
- If applying for a TSMIT/CSIT concession:
- The employer must complete the concession form
- The concession must be approved before lodging the Pathway 1 nomination application.

👉PATHWAY 3 – Regional NSW Graduate
Study requirement:
- Must have completed one of the following in regional NSW:
Bachelor’s degree
Master’s degree (coursework or research)
PhD

Occupation eligibility:
- Only occupations listed on the NSW Regional Skills List are eligible.

Relevance of study:
The completed qualification must be directly related to the nominated or closely related occupation.

Timeframe:
- The qualifying study must have been completed within the last 2 years immediately before applying for NSW nomination.

- NSW has a limited allocation for subclass 491 nominations.
- Investment NSW may close Pathway 1 or Pathway 3 at any time once places are exhausted.

🟡Office closed 24 Dec 2025 – 2 Jan 2026; ROIs can still be submitted online, but no processing or invitations during this period.

🟡Subclass 491 – Tasmanian Skilled Employment Pathway:
- Orange-Plus attribute points increased from 30 → 35 for 12–18 months relevant employment.
- Orange attribute updated to clarify salary range above minimum wage but below $57k.

🟡Subclass 190 & 491 – Skilled Graduate Pathway:
- Graduate program offers can now be claimed even if the program has started, if received within 12 months.

🟡Subclass 190 – Established Resident Pathway:
- Business owners must show ≥2 years operation, minimum personal income $76,515, and net profit achieved.

NSW Skilled Migration Program – Important Updates for 2025/26!

Here’s what you need to know:

🟡NSW has announced its skilled visa allocations for the new program year:
190 Visa: 2,100 places
491 Visa: 1,500 places

🟡Subclass 190 – Skilled Nominated Visa
- Three invitation rounds already completed.
- Monthly rounds resume from Jan 2026.
- 25% of annual places already used.
- Only occupations on the NSW Skills List will be invited.

🟡Subclass 491 – Regional NSW
- Pathway 1 (Work in Regional NSW) and Pathway 3 (Regional Graduate) open on 19 Jan 2026.
- Applications will be processed in the order received—only valid applications will enter the queue.

🟡A valid application includes:
- Meeting all NSW eligibility criteria
- Valid English test + skills assessment (must remain valid for 5+ days after applying)

🟡Priority (expedited) processing available if:
- Your visa or documents are expiring soon, OR
- You will lose age points within 10 working days.

🟡Pathway Highlights:
