⚖️ Serious Offences in NSW: Understanding How Sentencing Works

If you’ve been charged with a serious criminal offence, it’s common to assume sentencing is predictable or fixed — but in reality, NSW courts have significant discretion. Your personal circumstances, the nature of the offence, and a range of aggravating and mitigating factors all play a role in determining the outcome.

Our article breaks down:
🔹 How sentencing decisions are made
🔹 Aggravating and mitigating factors
🔹 What “standard non‑parole periods” actually mean
🔹 How early guilty pleas affect the final sentence
🔹 Why two similar cases can still result in different outcomes.

Understanding the process is the first step toward preparing the strongest possible defence.

Fraud matters can unfold slowly and often long before you even know you're under investigation.

Once an investigation begins, investigators move methodically: reviewing financial records, interviewing witnesses, executing search warrants and utilising forensic accountants to trace funds.

Our latest article breaks down:

🔍 What a fraud matter looks like
🔍 How investigations typically begin
🔍 What agencies are involved
🔍 What happens during the investigation phase
🔍 How long investigations can run

LEGAL JARGON

What does adjournment mean? 🤔

If you’ve been to court, you’ve probably heard this term. An adjournment is when a case is postponed to another date, often to allow more time to prepare or get legal advice or to come back to court for hearing.

While adjournments are common, they’re only granted when there’s a good reason and it’s fair to do so.

Need advice about your court matter? We’re here to help.

AUSTRAC's compulsory powers were introduced by the Anti-Money Laundering and Counter-Terrorism Financing Amendment Act 2024. These reforms aim to make it more difficult for money to be laundered through the legitimate economy. The changes impose new reporting obligations on many small businesses.

AUSTRAC may issue s172A notices which require a person to attend an examination, answer questions and provide documents. Individuals and businesses are entitled to be represented by a legal practitioner during an examination. Any person receiving a s172 notice ought to obtain independent advice early from a criminal defence lawyer.

HIDDEN CONSEQUENCES OF A CRIMINAL CHARGE

Even before a case is finalised, a charge can affect a person's:

⏺ employment
⏺ licences
⏺ visas and travel
⏺ family law arrangements
⏺ reputation.

That's why criminal defence isn't just about court dates.

It's about understanding the broader impact and managing risk at each stage.

Two weeks ago, Shane and Alex appeared with counsel in the Supreme Court, challenging an interlocutory decision that had halted proceedings for our client. Judgment was handed down more recently, setting the matter back on track.

A great result means our client can move on with his matter and resolve it sooner than otherwise, in the way intended. 💼⚖️

Not all matters require a conviction.

A Conditional Release Order (CRO) without conviction is a sentencing option available to the Court.

A CRO might be appropriate where:
✔️ The offence is at the lower end of objective seriousness
✔️ The person has no prior criminal history
✔️ The Court is satisfied they are unlikely to reoffend.

If you've been charged, understanding your options is critical. Our team will guide you through every available pathway.
