ACADEMIC POST - Today, I officially joined the teaching staff as a “Casual Academic” (LAWS 2004 Criminal Law) at Western Sydney University, where I continue my additional role as Intern Supervisor (LAWS 3077 Internship) subject, as well as Principal Donor of the Dean’s Award for Most Outstanding Student in Criminal Law.

It’s been a dream of mine to join the academic team at my former University’s Law School for a while now - and while I may be away for a day every academic week of each semester, I am still devoted to the firm and justice…

⁉️ What on Earth are “Mitigating Factors” ⁉️

Presenting mitigating factors orally when speaking to the Magistrate in Court helps His/Her Honour contemplate whether the offence is “less” serious on an imaginary scale, and at least if I say it rather than just slip the arguments into the paper bundle the Magistrate reads, it’s typed into the transcript incase we need it for an Appeal…

The antithesis (opposite) of this is “Aggravating Factors” which raise the objective seriousness of an offence.

𝗟𝗔𝗪𝗬𝗘𝗥’𝗦 𝗣𝗢𝗦𝗧 - 𝗜𝘀 𝗶𝘁 𝘁𝗼𝗼 𝗹𝗮𝘁𝗲 𝗳𝗼𝗿 𝗮 𝗽𝗮𝘁𝗶𝗲𝗻𝘁 𝗶𝗻 𝗽𝗮𝗹𝗹𝗶𝗮𝘁𝗶𝘃𝗲 𝗰𝗮𝗿𝗲 𝘁𝗼 𝗱𝗼 𝗮 𝗟𝗮𝘀𝘁 𝗪𝗶𝗹𝗹 & 𝗧𝗲𝘀𝘁𝗮𝗺𝗲𝗻𝘁?

The answer is “no.” In fact, the phrase and desire to “get your affairs in order” is often at the top of the patient’s hypothetical self-intake list.

By executing (signing and witnessing) a legally-binding Will, the person ensure that their loved ones and those that they care about do not miss out and are provided for through the assets of their estate when the time comes.

Importantly however, there are a few things to consider regarding drafting and executing a Will when in palliative care:

✅ Sometimes it may be necessary for a Solicitor to perform a Legal and Mental Capacity Test to determine if the patient understands the importance of the instructions that they are giving and the significance of the document being drafted.

✅ A Geriatrician may be requested or required to conduct an Assessment and give a report as to the state and soundness of mind of the patient first.

✅ It is usually best practice to have the patient and both appropriate witnesses sign the Will, before the patient is administered strong pain relief medications such as Endone or Morphine, as such medications may affect the mind and ability to give sound instructions.
