⚖️ Schedule 3 of the Migration Regulations is a set of additional criteria that apply to certain people who apply for a visa while in Australia without a substantive visa (for example, after their visa has expired and they only hold a Bridging Visa or are unlawful) - basically the requirement being that you should apply for a new substantive visa within 28 days of your old one expiring.

Its purpose is to discourage people from overstaying and then applying for another visa onshore.

For visa subclasses that incorporate Schedule 3 (such as the Subclass 820 Partner visa), the applicant must either:

- satisfy the relevant Schedule 3 criteria (e.g. applying within 28 days of ceasing to hold a substantive visa), or
- convince the Minister that there are compelling reasons why those criteria should be waived.

25 Temmuz 2026 itibarıyla yürürlüğe giren Ministerial Direction 119, birçok skilled vize ve sponsorluk başvurusunun değerlendirilme sırasını değiştirdi.

Family Visa Changes Announced … But Don’t Expect Faster Processing Times

The Australian Government has announced minor changes to Family Stream visa planning levels for the upcoming program year.

• Child Visas: 3,000 → 3,500 places
• Parent Visas: 8,500 → 7,060 places
• Other Family Visas: 500 → 400 places

Although these changes have attracted attention, they are relatively modest and are unlikely to result in meaningful reductions to current processing times or waiting periods.

For applicants already in the queue, expectations should remain realistic, as these adjustments do not represent a major expansion of the Family Stream program.
