We appeared for our client in appeal against a conviction and severity against their sentence for an affray and assault. They received a conviction for both counts initially; and given they wanted to challenge the grounds of the case they approached us. After giving our legal advice we prepared our client’s case. Despite the prosecutions resistance against our client’s conviction being overturned we at the end of the day walked out with no convictions for both offences. A no conviction for an affray charge is as rare as they come.

We appeared for our client at Waverley Local Court who had been charged with an assault and damage property charge (DV). They were in a compromised position due to a number of events in their lives. As such, we proceeded with a s14 application under the Mental Health and Cognitive Impairment Forensic Provisions Act. We wrote representations in their damage property charge which was withdrawn. The s 14 application was successful and our client was conditional discharged for a period of 12 months. No criminal record and the right outcome!

We appeared for our client who was charged with a count of Actual Bodily Harm. Our client was unfortunately caught up in a tussle as a result of the alleged victim’s actions. As such, after further negotiations with the prosecution regarding the case we were successful in securing a withdrawal. Our client walks away with no mark against their name and can leave this daunting experience behind them.

In NSW and other states and territories the right to silence is a salient feature afforded to people questioned by police in relation to a alleged offence/s. In NSW it is codified in s89 of the Evidence Act which is also applicable in the Commonwealth law too! So if you’re ever in trouble with police remember you’re allowed to exercise your right to say nothing at all which your lawyer will be pleased with 😅.

Our client was charged with 1 count of robbery, 2 counts of deprivation of liberty and common assault relating to an incident at Fortitude Valley. Given the seriousness of the offences the matter proceeded on committal. After lengthy negotiations we were able to have the robbery and deprivation of liberty charges withdrawn where we were left with common assault. Upon a plea of guilty at Ipswich Magistrates Court our client received a penalty with a no conviction.
