Child maintenance before and after birth: what the law actually requires

Many parents don’t realise that financial obligations can arise during pregnancy and shortly after birth, not just after separation. Under Australian family law, a father may be required to contribute to a mother’s reasonable living and medical expenses for a limited period around birth.

This operates separately from child support, applies regardless of relationship length, and is subject to time limits for application.

The SA Royal Commission has called for a ban on smacking and the removal of legal protections for physical punishment of children. If this change became reality there would be significant impact in the family law sphere, esp amongst high-conflict couples.

• Criminalising smacking would give victim-survivors stronger legal tools to act when they believe children are unsafe.
• A wider scope for prosecution for assault could provide additional valuable evidence for victim-survivors in family law matters
• Allegations of inappropriate discipline could be misused strategically by both parties and as a weapon of systems abuse
