Visa & Citizenship Lawyers were contacted by A Current Affair to comment on the circumstances of a woman, who moved to Australia 15 years ago and shortly afterwards had a child who is now an Australian citizen.

Due to a chain of events, the woman is now holding a bridging visa which expires in a few days, at which time she will become an unlawful non-citizen liable to be put in immigration detention and removed from Australia, separated from her Australian citizen daughter who requires full-time care and daily medical support.

The woman's pathway to permanent residency is complex as she has previously been granted a visa through Ministerial Intervention.

Interesting times ahead for certain industries such as hospitality where the Temporary Skilled Migration Income Threshold (TSMIT) will be raised from $53,900 to $70,000 from 1st July 2023.

The TSMIT is the minimum salary that can be paid to certain employer sponsored work visa holders.

There's been a lot of debate about this topic for well over a year, with people strongly not in favour of such a significant raise, whilst others have stated that the raise should have been higher.

CITIZENSHIP APPROVAL (with traffic offences) 😊
Our client had been a permanent resident of Australia for around two years, and sought to become an Australia citizen. However, they had previous traffic offences that needed to be addressed.
We lodged their citizenship application with carefully drafted Statutory Declarations regarding our client’s good character. We also had a face-to-face consultation to prepare for their citizenship interview and test.
About three weeks after the client attended their citizenship interview, we received a letter from the Department of Home Affairs approving his Australian citizenship.
Congratulations! We look forward to hearing about our client’s attendance at their citizenship ceremony, which is to occur in just a few week’s time.

The visa was applied on 10 March 2022.
The grant was received on 9 December 2022.

ANOTHER PERMANENT PARTNER VISA GRANTED :)

Our clients met on an online dating app, which developed into a long-distance de facto relationship. They were unable to meet until January 2022, when the visa applicant obtained a travel exemption to enter Australia. They entered Australia on February 2022 and engaged us to lodge an onshore partner visa. They hadn’t lived together for 12 months.

Today, in less than 5 months since the date of lodging the application, we received a “double grant” where our client was first granted the temporary partner visa, and then the permanent partner visa immediately after that. In less than a year, our client had become an Australian permanent resident.

OFFSHORE PARTNER VISA GRANT PROCESSED IN UNDER 2 MONTHS 😊

After a long-distance relationship caused by the COVID-19 pandemic, our clients reunited overseas and stayed there for work reasons. This year, they sought to migrate and settle in Australia. Importantly, they had not lived together prior to their recently marriage about a year ago due to religious reasons. However, they had plenty of other evidence addressing the four pillars to show their genuine and continuing marriage.

We applied for an offshore partner visa on their behalf explaining their circumstances, and in less than 2 months, the offshore partner visa was granted.
