Was your Will about to be caught by a new 30% tax?

For a while it looked that way. Testamentary trusts were swept into the Government's proposed minimum trustee tax in the May Budget. On 18 June, the Treasurer confirmed they will be carved back out.

BUDGET BACKDOWN - TESTAMENTARY TRUSTS SPARED THE "DEATH TAX".
On 18 June 2026, the Treasurer confirmed that discretionary testamentary trusts will be carved out of the proposed 30 per cent minimum tax on trusts.

QUICK RECAP.
The Budget had swept discretionary testamentary trusts into a new 30 per cent minimum tax from 1 July 2028. The catch: most testamentary trusts do not exist yet, because the will maker is still alive. So wills written today looked set to be caught. Hence the "death tax" label.

That cloud is now lifting.

Which means the reasons to build a will around a testamentary trust are back on solid ground:
- Income to children and grandchildren taxed at ordinary adult rates, not penalty rates.
- Asset protection if a beneficiary hits divorce, creditors or bankruptcy.
- Flexibility for your trustee to support the right people, in the right year.

One caveat worth stating plainly: this is an announcement, not law yet. The detail still has to clear consultation, amendments and the Senate. Do not rewrite anything on the strength of a press conference.

But if a will has been on your to-do list, this is a good week to move it up.
