TRADEMARK REGISTRATION

Recently I commented on a post and provide my comment reply below should it be useful to others.

The query was:
Need some guidance on trademark registration..... Do we need to engage a trademark specialist or is this something we can do it all by ourselves?

My comments were:
Hi ###xx. I'm an Australian IP lawyer, Australian and New Zealand Registered Patent & Trade Mark Attorney.

If you require advice for your specific circumstances, then it would be prudent that you get professional advice by a suitably qualified professional.

Your question "do we need to engage a trademark specialist or is this something we can do it all by ourselves?" appears to be focused on reducing costs by self-filing a trademark application.

Your question does not address the potential legal and financial risk and consequences associated with adopting a new trademark for use in the marketplace irrespective of whether it is registered or unregistered.

Before adopting/using a new trademark in the Australian marketplace (or any other) it would be prudent that you ask your-self at least the following questions if you already have not done so:
1. Can I use the proposed trademark in the Australian (or other intended) marketplace without infringing another person's/business legal rights?
2. Is my proposed trademark potentially registerable? If so is it easily registerable or not?
3. What version(s) of the proposed trademark and scope of goods and services provides me potentially the broadest scope of protection if registered for and is in alignment with the commercially important aspects of my existing or proposed business activities?
4. Who is the eligible person or legal entity that is entitled in law to file a valid trademark application?
5. Who should be the ultimate owner of the trademark registration, so it is protected from business risk?

If you are already familiar or have experience with trademarks and have addressed the above-mentioned prudent questions, then IP Australia provides significant informational and filing resources to make it easy to seek registration of a trademark however it is important to note IP Australia only facilitates the administrative process of getting registration.
