What is a caveat?

- A caveat is a court order to stop a property from selling without consent
- It blocks property transactions and alerts the caveator - eg. Sale/Transfer of property
- It doesn't grant ownership or selling rights
- Used for securing interests, such as loans.

We hear of these being placed on properties by people that may have an interest in it such as an ex-lover or disgruntled relative.

In the recent Federal Budget, first-home buyers received a boost through the expansion of the First Home Guarantee and Regional First Home Buyer Guarantee. Starting July 1, 2023, joint applications will be allowed for friends, siblings, and other family members, previously limited to singles or couples. These schemes enable eligible buyers to enter the market with just a 5% deposit, exempting them from lender's mortgage insurance.

So now is a great time to get into the market as a first home buyer. Remember, the First Home Guarantee caters to 35,000 eligible first home buyers annually, while the Regional First Home Buyer Guarantee is available to 10,000 individuals.

Did you know that for all motor vehicle-related injuries sustained in the ACT on or after 1 February 2020, the Motor Accident Injuries Act 2019 applies?​​​​​​​​

The scheme changed from a common law, full compensation regime for people injured through no fault of their own to a no-fault, limited defined benefit scheme.​​​​​​​​

What does this mean? This means that regardless of who was at fault for the accident, injured persons are entitled to compensation for their injuries. The scheme provides coverage for medical expenses, lost income, and other expenses related to the injury.​​​​​​​​

WHO IS A NON-RESIDENT?​​​​​​​​​Non-residents include temporary residents and foreign non-residents.

If you are a non-resident of Australia before you buy property within Australia, there are a few things you need to be aware of:

1. You will need permission from the Foreign Investment Review Board (FIRB). The application fee for this will depend on the value of the land and can range between $4,000 and $200,000.
2. The Australian Government regulates the type of properties non-residents can purchase. Generally speaking, foreign investors are not allowed to purchase established dwellings in Australia. However, an exception to this rule is if you are a temporary resident - provided that you sell the property when you leave Australia.
3. In addition to the application fee for FIRB approval, you may also need to pay a vacancy fee (if your property is empty for more than 6 months of the year), foreign ownership surcharge, land tax if the property is not your principal place of residence, surcharge purchaser duty in addition to your stamp duty and, surcharge change land tax.

Know what you are getting into.​​​​​​​​​

A pre-purchase contract review will:

1. give you peace of mind by identifying any potential issues or risks associated with the transaction.
2. avoid any nasty surprises down the line. A pre-purchase contract review will look for things such as potential new developments that will impact the neighbourhood or additional fees that might come with the property.
3. ensure the property is fit for purpose. For example, there may be restrictions on the use of the property.
4. analyse any special conditions. We will advise you on the implications of the special conditions and negotiate to amend them if necessary.
5. eliminate risks by conducting searches relating to the property to ensure the property you are intending to buy is what it is represented to be.

If you sign a contract without having it reviewed, you are consenting to whatever it includes, whether you like it or not. If you discover something in the contract that you do not like after signing it, you may not be able to amend it.
