As an Immigration Lawyer, what I love most about Australia's Immigration system is a safety net called a Ministerial Intervention. Under the Migration Act 1958, the Minister of Immigration, Citizenship, Migrant Services and Multicultural Affairs can
replace a decision of a merits review tribunal with a decision that is more favourable to that person if the Minister deems the matter to be in the Australian national interest. The Minister rarely intervenes and this pathway of appeal was designed specifically to assist people who find themselves needing to remain in Australia due to exceptional and compelling circumstances.

UPDATED: ✈️ Want to travel overseas but not sure about the rules?

Fully vaccinated citizens and permanent residents (and their immediate family) can now fly into NSW without having to quarantine:

• You need to be double vaccinated with a recognised COVID-19 vaccine, or be accompanied by someone 18+ who has if you’re under 12 years old
• If you meet the vaccination and the Australian Government pre-departure testing requirements you can leave the airport as normal
• Within 24 hours of arriving in NSW, you must have a COVID-19 nose and throat PCR test.
• Get another test on or after day 7 after arriving in NSW. You don’t have to isolate while waiting for your results, unless you have symptoms. Until you get a negative result from your day 7 test you can’t go to any high-risk settings such as aged care, disability care, healthcare and correctional facilities. Different rules apply to children under 12 who are unvaccinated.
• If you develop any symptoms of COVID-19 at any time while in NSW, you must immediately get tested for COVID-19 and isolate until you receive a negative result.

International students to return to NSW by December 2021

There are currently 57,000 international students who have not been able to enter NSW since March 2020. NSW Treasurer Dominic Perrottet has confirmed the NSW state government is planning to start the process of welcoming the students back, so long as they are fully vaccinated with Therapeutic Goods Administration (TGA) recognised vaccines including Pfizer, Johnson and Johnson, Moderna and AstraZeneca.

Priority will be given to those who are PhD students, those who have nearly completed degrees, and students studying medicine and health-related courses.

Hundreds of international students will be welcomed back to NSW before the end of the year under a pilot program but students from China and Nepal will likely be excluded.
