The key is complying with Regulation 13.22C.

To qualify:
✔️ The trust must be a genuine unit trust
✔️ No borrowing allowed
✔️ No mortgages or charges over assets
✔️ No business activities
✔️ No investments in other entities
✔️ Related-party leases only for business real property on market terms

But there is a major warning: under Regulation 13.22D, a single breach can permanently taint the structure and cause serious SMSF compliance issues.

Most SMSF trustees think their BDBN is locked in.

It’s not.

In many cases, it silently expires every 3 years—depending on the trust deed.

That means:
❗ No valid nomination
❗ Trustee discretion applies
❗ Benefits may not go where intended

The High Court (Hill v Zuda) made it clear—
BDBNs don’t have to lapse… but only if the deed allows it.

The real risk?
Many deeds still enforce lapsing rules.

Can your SMSF invest in crypto? Yes — but there are strict rules.

Many trustees are surprised to learn that you cannot transfer personal crypto into your SMSF, and the fund cannot buy crypto from members or related parties under the SIS Act.

If an SMSF wants to invest in cryptocurrency, the fund must purchase it directly using its own cash.

There are also borrowing restrictions, lending rules, and audit considerations that trustees need to understand before investing.
