The best strategies for defending a summary hearing involve considerations of proof, reliability and credibility. If your only defence is hope that the victim or other witnesses won't attend court, you need to have a plan "B" and "C" ready to go. Thoroughness and attention to detail are more likely to yield a good result. Witnesses: What happens when they don’t turn up? Many of my clients think that if the witness doesn't attend court, the charges will be withdrawn. It is not that simple or straightforward and carries potential risks for an accused person.

If the victim doesn't attend court, will the charges be withdrawn or dismissed?

I've just heard that Correctional Services officers in NSW have gone on strike. I'm not sure what this will mean for anyone held in custody.

I hope release/bail applications can go ahead. Otherwise, a lot of people are going to be held in custody for no other reason than their applications can't be heard.

Clients pay $1000s for transcripts which are riddled with errors and missing crucial parts of the judge’s or magistrate’s remarks.

I then get the audio recordings and the remarks are still missing. How can this happen in a supposedly open system of justice?!!

Obtaining court transcripts can cost thousands of dollars for a single day of proceedings, but the documents can contain errors, missing text, and even wrong attribution, frustrating legal practitioners who say the flaws impede justice.
