✨ Another remarkable outcome through Ministerial Intervention ✨

Today we celebrate an extraordinary result for our client, who was granted a Subclass 449 Humanitarian Stay (Temporary) visa yesterday and, following that grant, was granted a Subclass 851 Resolution of Status visa today.

Our client arrived in Australia from Iran in 2012 as an unauthorised maritime arrival, seeking safety and the opportunity to build a secure future. Over the past 14 years, Australia has become his home, where he has built strong community ties and established a life with his de facto partner, an Australian citizen, with whom he has shared a committed relationship since 2014.

For more than a decade, the uncertainty surrounding our client’s immigration status has had a profound impact not only on him, but also on his partner as they both faced years of uncertainty about their future together, the emotional strain of potential separation and the ongoing stress that comes with not knowing whether the person you love will be able to remain in the country you call home.

Through our Ministerial Intervention submissions, we asked that our client’s unique circumstances, lengthy residence in Australia, enduring relationship with his Australian citizen partner and compelling humanitarian considerations be recognised.

The outcome achieved over the past two days represents far more than the grant of visas. It provides certainty, stability and the opportunity for this couple to finally plan their future together with confidence after many years of uncertainty.

We are honoured to have played a role in securing this life-changing outcome and grateful that our client’s circumstances, and the impact on his Australian citizen partner, were recognised.

Cannot really believe that 4 years have passed by. Good to remember this achievement on King’s Birthday weekend

We successfully received 90 449 grants for the Judges and their families in December 2021 under Minister Alex Hawke

We also received 10 PR grants for judges and 10 families in 2022 under the new Labor Government.

Today we celebrate an incredibly meaningful result for our client, who has been granted a Subclass 449 Humanitarian Stay (Temporary) visa following our Ministerial Intervention request.

Our client came to Australia from Iraq seeking safety and the comfort of being surrounded by the people who mean everything to her, her family.

As a widow, Australia is not just where she lives; it is where her entire support network is. Her children and grandchildren are all here and she plays an irreplaceable role in their lives. To her grandchildren, she is not only their grandmother, she is a source of love, stability, culture and connection.

Through our submissions, we asked that her unique circumstances, compassionate factors and deep family ties in Australia be recognised.

We are honoured to have played a role in helping keep this family together and securing a pathway that allows our client to remain close to those who depend on her most.

Today, we are delighted to celebrate the birthday of our Managing Director and Principal Solicitor, Anne O’Donoghue.

Anne was surrounded by beautiful flowers and showered with heartfelt well wishes from the entire team, a reflection of the deep respect and appreciation she has earned through her leadership at Immigration Solutions Lawyers.

A special highlight of the day was receiving flowers, a warming amount of messages and best wishes, including a thoughtful birthday card from the team at Genazzano FCJ College. This generous and meaningful gesture was deeply appreciated and added a special touch to the celebrations.

We’re pleased to share a significant positive outcome before the Administrative Review Tribunal (ART) ⚖️

Our client initially faced refusal of a Subclass 600 Visitor Visa, followed by a consequential offshore Subclass 309 Partner Visa refusal under Section 501(1) of the Migration Act on character grounds, with discretion exercised to refuse. The criminal offences in question spanned a period of over 15 years.

Despite the refusal, we formed the view that the Applicant had a strong demonstrated capacity for rehabilitation and a low risk of recidivism, both of which were supported and affirmed in an independent report from the treating clinical psychologist.

We were engaged to undertake the review and prepared a detailed submission supported by strong evidence, including a clinical psychological report, statutory declarations from family members, witness statements from his wife in Australia, and material addressing the impact on the family, including his wife’s business and grandchildren.

A lot was at stake for the Applicant, his Wife and their extended family in Australia.

With Detailed Submission and advocacy before the Tribunal, following consideration of the evidence, the Tribunal determined:
“The reviewable decision is set aside, and the matter is remitted to the Respondent with a direction not to exercise the discretion provided in s 501(1) to refuse to grant the visa.”

A strong reminder of the importance of comprehensive, evidence-based advocacy in complex character matters. Amazing outcome for all!
