From zero dollars to a six-figure settlement.

This client was initially assessed at zero percent whole person impairment, which meant no compensation for non-economic loss. We challenged the medical assessment and the review panel accepted that there had been a material error.

After reassessment by a panel of three doctors, the original certificate was revoked and a new finding was made above the required threshold.

An injury while working does not automatically mean you are entitled to workers compensation.

A workers’ compensation claim and a work injury damages claim are not the same thing.

If your injuries exceed the required impairment threshold and employer negligence can be established, you may be entitled to claim compensation for lost future earnings.

However, receiving a work injury damages payout may end your existing workers’ compensation entitlements—so it’s important to understand the long-term impact before proceeding.

When does an injury suffered outside ordinary working hours still arise in the course of employment?

In Hatzimanolis v ANI Corporation Ltd, the High Court accepted that a worker injured during an employer-organised recreational excursion remained within the course of employment. The employer had encouraged the worker to participate in the activity during an interval in a remote work assignment.

But in Comcare v PVYW, the outcome was different. Although the employee was required to stay overnight in accommodation arranged by her employer, her injury occurred during a private activity that the employer had neither induced nor encouraged.

The key distinction is between:

⚖️ an injury arising from a place where the employer required or encouraged the worker to be; and

⚖️ an injury arising from an activity, where the activity itself must have been induced or encouraged by the employer.

Two unusual cases. Two different outcomes. One important question:

Was there a sufficient connection between the employment and the circumstances that caused the injury?
