Double win! On Friday, Mr Jonathan Jaramillo, partner, appeared in a defended hearing on a drug possession charge. The prosecution withdraw the charge before the hearing started due to our argument that onlya trace amount of a drug does not constitute possession. At the same time, Mr Tom Seeney was successful in an application for dismissal pursuant to section 32 of the Mental Health Act (NSW). Although section 32 has been replaced, Mr Seeney was able to bring his application because the proceedings were initiated prior to the passing of the meeting legislation. Stunning results for both clients!

Bail granted! Mr Jonathan Jaramillo appeared this morning at Parramatta Bail Court. Our client was arrested last night on a serious case involving a prolonged assault and kidnap, but Mr Jaramillo argued that even taken at its highest, the Crown case was flawed. The magistrate agreed and granted our client bail.

Last week, Mr Tom Seeney appeared as solicitor advocate in the Supreme Court of New South Wales for a release application. Our client is charged with a serious offence in the Local Court, but it is his first time before the court for any offence. Mr Seeney fought hard and our client was released to his supportive family.

At James and Jaramillo, we collaborate to achieve the best results for our client. This week our client was sentenced for a serious and complex Commonwealth offence that was the first of its kind in Australia. We negotiated with the CDPP and eight charges were withdrawn. Our client pled guilty to a one count indictment and is eligible for release in May 2021.

After 13 months of litigation and strict bail conditions, our client engaged our firm after two previous lawyers failed to make any progress in his criminal law matter. Jonathan Jaramillo, partner, appeared in the Local Court as solicitor advocate in a two-day defended hearing that resulted in all charges being dismissed. Today, Mr Jaramillo successfully recovered our client’s legal costs for the last 13 months across the three law firms, just in time for Christmas. After taking over the case, Mr Jaramillo wrote to the NSW Police and promised he would sue for legal costs if they continued the prosecution. We don’t make threats. We take action.
