Young workers and in particular international students, many of them without family support, are not only exploited financially. In our experience, often, should young visitors to Australia like Amanda suffer a work injury, their employer denies the relationship, the accident and refuses to help them.

Each year, tens of thousands of Australians suffer a work injury in their place of employment. For many, these injuries result in serious permanent injury and ongoing disabilities. WorkCover NSW has been established to assist injured workers obtain weekly payments and associated benefits - rehabilitation, medical expenses, lump sum compensation and in some cases, modified common law damages by way of loss of income until retirement age. In certain situations, the full range of common law damages may be available to workers injured while working away from their place of employment.

The workers compensation system is a highly technical and complex system, with many traps for the unwary. All too often, injured workers rely on their workers compensation insurers to take care of them in their time of need. This is not necessarily the case. At the end of the day, the workers compensation insurer has an overriding mandate to get injured workers rehabilitated and back to work in the shortest time possible. They may not be forthcoming in explaining all rights of injured workers, such as ongoing medical treatment for all injured body parts, appropriate work capacities or how to obtain the lump sum compensation.

Injured workers should seek medical assistance as soon as possible. It is also important to consult a solicitor experienced in managing workers compensation claims. Should your workers compensation insurer deny your claim, you can challenge their decision through the Workers Compensation Commission.

In NSW injured workers are entitled to compensation regardless of whether or not they contributed to their injury. Legal fees for all workers compensation disputes are funded by the NSW Government.

Claiming for working for home is fraught. It's safest to claim the running expenses the tax office allows. 'Occupancy expenses' are harder to justify and could cost you your capital gains tax discount.
