Low Range Drink Driving in NSW: Can You Lose Your Licence?

Many people are surprised to learn that even a low range drink driving offence in NSW can result in an immediate licence suspension.

For many first offences, police may issue a penalty notice and suspend your licence for 3 months, meaning you may lose your licence without first going to court.

You may also have the option to elect to have the matter dealt with by a court. However, this is not a decision to make lightly, as the outcome will depend on your circumstances, your driving history and how the matter is prepared.

If your licence is important for work, family responsibilities or daily life, getting advice early can help you understand your options before deciding what to do next.

We’ve put together a guide explaining drink driving penalties in NSW, including low range offences, immediate suspension, court options and when legal advice may be helpful.

Struggling to recover unpaid debts? Here’s what you can do.

Unpaid debts can significantly impact your business’s cash flow and operations. Recovering these debts requires a strategic approach, including issuing demand letters, negotiating payment plans, and, if necessary, pursuing court action. Understanding the legal process can help you recover debts efficiently while maintaining professional relationships.

Debt recovery begins with clear communication and documentation. Sending a formal demand letter is often the first step, outlining the amount owed and the consequences of non-payment.

The consequences may include interest accruing on the amount owed and paying additional amounts for legal or enforcement costs. If this does not resolve the issue, legal proceedings may be necessary.

If the debtor is a company and does not dispute the debt, the issue of a Creditor’s Statutory Demand may also be a suitable approach to enforce payment.

If you would like advice about the best strategic approach to take to recover an unpaid debt, please call us on 9525 8688 or email us at [email protected].

Could the Federal Budget impact your Will?

The Government has announced proposed changes to discretionary trust taxation — including a potential 30% minimum tax framework from 2028.

While the legislation is still evolving, the changes could affect many estate plans that rely on discretionary testamentary trusts.

If your Will includes trust structures, investment assets, family businesses or intergenerational wealth planning, now may be the time to review your strategy.

Our latest blog explains:
✔ what has been proposed
✔ why it matters for estate planning
✔ who may be affected
✔ what steps people should consider now

Who Can Challenge a Will (and When Does It Happen)?

A Will isn’t always the final word.

In NSW, certain people can challenge a Will if they believe they haven’t been adequately provided for. This often includes spouses, children, former partners and, in some cases, dependants.

These claims are time-sensitive. In most situations, you have 12 months from the date of death to bring a claim and delaying can limit your options.

If you’re unsure where you stand, getting clarity early is key.
To help you understand your rights and how these claims work, we’ve created a free Estate Planning eGuide.

Happy Mother’s Day!

Today is a time to celebrate mothers, the role they play, and the care they show every day.

But we also know that Mother’s Day can bring a mix of emotions. For those navigating separation or change, it can feel a little more complicated.

At WMD Law, we work with families at some of the most challenging points in their lives.

As a mother, Director of WMD Law and an Accredited Family Law Specialist, Lisa O'Leary brings both professional expertise and personal understanding to every matter.

She works closely with newly separated families, helping them find a path forward that prioritises their children and reduces unnecessary conflict.

As a trained Collaborative Lawyer, Lisa can help clients resolve matters through a structured, out-of-court process focused on cooperation, not conflict.

Our focus is simple, to resolve matters wherever possible, without litigation. Because for families, less conflict means a better future.

Today, we recognise the strength of all mothers, in every situation.

Five Areas of Law Working Together

It often starts with one issue… But rarely ends there.

A client comes to us about a separation.

But the situation quickly becomes more complex.

There’s a family home to divide.

A business that needs to be valued and restructured.

Questions about asset protection and future financial security.

And decisions that may impact their estate planning moving forward.

This is where having the right legal team matters.

At WMD Law, our lawyers work together across:
• Family Law
• Property Law
• Estate Law
• Criminal Law
• Commercial Law

So instead of receiving fragmented advice from multiple firms, our clients benefit from one coordinated strategy that considers the full picture.

The result?
• fewer gaps or risks being overlooked
• more efficient and cost-effective outcomes
• clearer guidance during complex situations

When legal matters overlap and they often do, working with a firm that understands your unique position and how everything connects can make all the difference.

If you’re dealing with a situation that requires legal assistance, please contact us on 9525 8688 for a free initial phone consultation.

We asked one of our Family Law Specialists Lisa O'Leary about some of the most common questions people have after separation.

Here’s what she told us:

1. Who gets the family home?
“There’s no automatic rule and all of the family’s financial circumstances must be considered. The law considers a range of factors including financial contributions, non-financial contributions and each person’s current and future circumstances.”

2. Do we have to go to court?
“No. Most family law matters are resolved through negotiation or mediation without the need for disputed court proceedings.”

3. How are parenting arrangements decided?
“The law focuses on the best interests of the child as the most important consideration, and requires consideration of other factors including their safety, their needs and the benefits of maintaining meaningful relationships with both parents.”

Separation can be a difficult and uncertain time. Understanding your rights early can help bring clarity and confidence about the next steps. If you have a family law question call us on 9525 8688 for a confidential discussion about your unique situation.

Double demerits are now in force

Drivers in NSW and ACT should take extra care on the roads over the upcoming long weekends.

Double demerits apply:

• Easter long weekend: 2 April – 6 April 2026
• ANZAC Day long weekend: 24 April – 27 April 2026

During these periods, offences such as speeding, mobile phone use, not wearing a seatbelt, and riding without a helmet attract double the usual demerit points.

It’s a timely reminder to slow down, stay focused, and prioritise safety, for yourself and everyone on the road.

Discrimination claims are rising – Is your business prepared?

Employment discrimination claims can arise when an employee believes they have been treated unfairly because of characteristics such as race, gender, age, disability, or other protected attributes.

What can employers do to protect themselves?
For employers, having clear workplace policies, providing training, and responding promptly to complaints are important steps in reducing the risk of discrimination claims.

In Australia, discrimination complaints may be made to the Australian Human Rights Commission, and in some circumstances, employees may also bring a general protections claim through the Fair Work Commission. There are strict time limits that apply to these claims, and disputes are often first addressed through conciliation before court proceedings may be considered.

How can WMD Law help?
Our team assists both employers defending workplace claims and employees who believe they have been unfairly discriminated against.

If you would like advice about your rights and obligations in relation to workplace discrimination matters, please contact the WMD Law team by calling 9525 8688.
