What if you or a loved one cannot make decisions on your own behalf due to illness or circumstances? Do you have arrangements in place to enable decisions to be made urgently on your behalf if required? Do you know what could or would happen if such a situation arises and you do not have arrangements in place?

A Power of Attorney or a Medical Treatment plan will enable this to occur. You can have the power effective immediately or only to be utilised if circumstances arising requiring same, and appoint one or more Decision Makers.

On 12 March 2018, legislation changed in relation to making such arrangements for medical issues and there are options available whereby you can appoint a person to make decisions on your behalf, or you could even provide specific details about what you want to happen to you in the event that a serious medical issue arises by way of an Advance Care Directive.

More than one Decision Maker can be appointed, however, only one person can act at any given time. This will work as a list, with the first person on the list who can be contacted and is able to act being the “Decision Maker”.

Do you know why you need a Will or need to update your Will ?

A Will is a legal document that begins upon your death, setting out your wishes for the distribution of your assets (your “Estate”) after your death. Inside the Will, you can specify who is responsible for making sure your wishes are followed (your “Executor”), and where and to whom your assets are to be distributed (your “Beneficiaries”).

Deciding how your estate will be dealt with requires careful planning – for example assets held as joint tenants pass to surviving tenants regardless of what is stated in the Will, and it is important you are aware of how all your assets will be distributed.

Confronting our own mortality can be difficult and discussing these issues with loved ones is often avoided. Similarly, children, siblings, parents and business partners can also find these issues sensitive and confronting. However a Will is essential as it ensures your assets are protected and that your estate is divided the way you want it to be. Without a Will, your estate will be divided according to the law, which may not align with your wishes.

Ideally you should review your Will every 5 years or otherwise upon the occurrence of a major life event to determine whether your Will needs to be updated.

When you have a legal dispute, we understand that the legal cost of Court proceedings and legal representatives can be very costly. However, not all disputes requires you to obtain legal representation and issue Court proceedings, noting a large number of disputes fall within the jurisdiction of the Victoria Civil and Administrative Tribunal. This is a low-cost and informal avenue where your dispute can be resolved, and you have the option to represent yourself, or have a legal representative if you wish to do so.

The Victoria Civil and Administrative Tribunal hears a range of legal matters, to name a few, Residential Tenancies, Planning disputes, Goods and Services disputes and Guardian and Administrator disputes including disputes regarding Enduring Power of Attorney.
