Working as a commercial litigator, most of my work involves large corporations, Supreme and District Court disputes, contractual claims, insolvency proceedings, and complex property and construction matters.
But every now and then, a matter crosses your desk that you might not usually take on. Sometimes, the story behind it compels you to step in.
This was one of those cases. Our client had been issued with a Notice to Leave her home. We challenged it on the basis that it was retaliatory. Before our application could be heard, the landlord sought urgent orders for termination of the tenancy and a warrant of possession.
Last week, following our submissions to strike out the application, the landlord withdrew their application. The Tribunal ordered a further three-month tenancy for our client and directed the landlord’s agent to remove all breaches from her rental profile. In turn, we will withdraw our client’s application to set aside the Notice to Leave and her appeal. Our client can now secure a new rental property without the shadow of incorrect breaches against her name, which would have impacted her ability to find a new rental property.
Overall, a great outcome, and a timely reminder that sometimes the matters that matter most are not about the size of the dispute, but the impact on people’s lives.
