πŸ‘©β€βš–οΈ NOT GUILTY!

Yesterday I appeared at Penrith Court. After a Hearing on a common assault charge, my client was found not guilty on the grounds of self-defence.

Great result for our client who maintained her innocence for over a year.

πŸ‘©β€βš–οΈ **At the Local Court today**

Today I was at Court to request a variation of bail conditions for my client. The Application was opposed by the Prosecutor but was ultimately granted by the Court.

**Why vary bail conditions?** πŸ“
Bail conditions are set to ensure the accused attends court and does not interfere with witnesses or the investigation. However, sometimes these conditions need to be adjusted due to changes in circumstances.

If you or someone you know is facing similar issues, remember that seeking legal advice is essential.

πŸ›‘πŸš¨ Important Update, NSW! πŸš¨πŸ›‘

As of 1 July 2024, new laws on coercive control are in effect. These laws aim to protect victims of domestic abuse by recognising and penalising non-physical forms of control and manipulation.

πŸ” **What's considered coercive control?** It can include:
- **Isolating** you from friends and family.
- **Monitoring** your movements, communications, or activities.
- **Financial control** – restricting access to money or resources.
- **Humiliation** or degrading behavior.

βš–οΈ **What does this mean?**
- if found guilty, you can face severe penalties, including jail time.
- Victims will have better protection and more avenues for seeking help.

The legislation is not retrospective, meaning it applies for conduct on or after 1 July and must be continuous/a course of conduct. This means we will probably not see these matters in the Court until August/September.

πŸš— New seatbelt detection cameras are here as of 1 July 2024. Buckle up correctly to avoid fines and, more importantly, protect your life!

βœ… **How to wear your seatbelt properly**:
1. **Lap belt**: Secure it low and tight across your hips, not your stomach.
2. **Shoulder belt**: Position it over your shoulder, away from your neck, and across your chest and regularly pull to remove slack.
3. **No twists**: Ensure the belt lies flat without twists or tangles.

⚠️ **Exemptions**: Medical conditions, drivers reversing, and certain delivery drivers are exempt.

Penalties and demerit points will apply if you are driving and you and/or your passengers aren't wearing your seatbelt properly, or at all.

After representations were made to the Police, an AVO was withdrawn against my client. This is a huge relief for someone when allegations are made against them that just won’t hold up in Court.

It is important if you have been served with an AVO to seek early legal advice in relation to your options.

Today I appeared at Court for a licence Appeal. My client had received a 3 month suspension from incurring too many demerit points. After hearing submissions from me the Court disqualified my client from driving for 1 month. This resulted in my client being able to retain his job which he wouldn’t of been able to do if he was off the road for 3 months. It is important to seek legal advice in relation to your licence, penalty notices and demerit points.
