Thinking about buying a franchise? Read the documents before you sign, not after
A franchise can be a great way into business. However, the franchise agreement, disclosure document and lease are long, technical and written to protect the franchisor. Most buyers skim them, sign and only discover what they agreed to when something goes wrong.
Before you commit, you should understand:
1. What the fees really are, including royalties and marketing contributions;
2. Your territory and whether it is actually exclusive;
3. Renewal rights and what happens at the end of the term;
4. Restraint clauses that limit what you can do if you leave;
5. How and when the franchisor can terminate the agreement;
6. Refurbishment and upgrade obligations that can cost you later and many more.
Under the Franchising Code of Conduct you are given time to consider these documents before signing. That time is there for a reason. Use it.
