Federal Court Justice Michael Lee has dismissed Bruce Lehrmann's defamation claim and finds him to be a ra**st on the balance of probabilities. For all those who attended my presentation last year on defamation in Bali for the Southern Solicitors Law Association, His Honour remarked that Mr Lehrmann indeed had mistakenly returned to the lion's den to retrieve his hat after the mistrial of the criminal proceedings in the ACT Supreme Court.

It is newsworthy to see that the law appears to have caught up with Mr Nugara. It is very distressing to see that the victims of his activities may have lost over $9 million. I have been acting for Mr Cameron Howe who recently lost a defamation case against a property developer in relation to third party posts that were posted on a FB community page that my client administered. He has been ordered to pay $205,000 in damages and will also face an adverse costs order. If you or anyone you know administers a FB page then special care needs to be taken under the present state of the law in relation to third party comments, and the risk that these comments may create.

While the law of defamation is currently under review and there are reform proposals being considered to address the situation that Mr Howe found himself in, it is important that at this time, any FB Administrator needs to take particular care in monitoring and if required removing third party comments that may be defamatory. While we are waiting on the County Court of Victoria to hand down its decision in a case involving the administrator of a community based page being sued for the third party comments published on the page by a property developer, the mood amongst some Administrators of these types of pages has definitely shifted following the High Court's recent decision in Voller.

It also raises the question as to whether individuals who are administrators of their own pages can be similarly liable as publishers for third party comments posts:

A High Court ruling means the administrators of community-run pages can be sued for what people write in the comments. What's the legal risk, who's willing to take it, and will the pages survive?

Are you running a business and have you made a claim under your business interruption insurance policy as a result of Covid-19?

Many insurance policies seek to exclude cover by way of references to “a quarantinable disease under the Quarantine Act 1908 and subsequent amendments”. However, the Quarantine Act was repealed in 2016 and replaced by the Biosecurity Act.

A recent test case heard by the NSW Court of Appeal in November 2020 has ruled that the Quarantine Act references in policies did not exclude the two claims in the test case. If your business has made a claim under such a policy and it has been rejected by an insurer, please contact us for advice and representation.
