MEET THE TEAM | ALLAN GRANT

Allan commenced his Articles of Clerkship in 1980, completed his Bachelor of Laws Degree (QUT) and was admitted as a Lawyer in August 1986 and undertakes continuing legal education and professional development. Allan completed his Articles with Grant & Simpson and became a Partner of the firm on the 1st July 1989 and is a fourth-generation member of the Grant family to practice as a Solicitor. Allan was then appointed a Notary Public in January 2008.

Allan has been working in the firm for over forty years and has expertise in a broad range of litigation matters, civil, family and criminal law actions, but particularly in some of the more specialised areas of law, such as:

➡️ Queensland Civil and Administrative Tribunal matters involving advice, preparation of documents and representation in building disputes, discrimination law and guardianship applications.

➡️ Employment law dealing with employment contracts, employment agreements, unfair dismissal claims and workplace health and safety issues.

➡️ Commercial litigation relating to the Fair Trading Act (QLD) and the Competition and Consumer Act (CTH).

Allan’s experience in these areas has been recognised by his selection as a Panel Lawyer for the Rockhampton Regional Council and previously for the Building Services Authority, the Master Builders’ Association and WorkCover Queensland.

SECURING YOUR DIGITAL ASSETS

It is becoming more common for people to hold digital assets, such as family photographs stored in the cloud, crypto currency and social media accounts.

These digital assets usually have unique passwords and other access requirements. Further, there may be terms and conditions which limit how these digital assets are dealt with once a person passes away.

As a result, it is important that you deal with your digital assets in your Will and/ or plan for them to be managed by someone you trust after you pass away. Otherwise, digital assets could become inaccessible or could be misused (for example on the dark web).

It is also important to let your executors know what digital assets you have and to ensure that they have legal authority and the required passwords to access digital assets in the event of your death.

As part of your estate plan and your Will, consider who you wish to deal with your digital assets when you die, including providing clear instructions in your Will. Do not put passwords or other such credentials in your Will, as it may become a public document through the probate process. Instead, this information should be securely stored (for example using a password manager).

MEET THE TEAM | SHELLEY CHISHOLM

After leaving school, Shelley studied Hospitality at QAC Gatton and spent many years working in management roles. After marrying she moved to the Brisbane Valley to help her husband run their Cattle and Pig Business. Shelley worked as a Teacher’s Aide during her children’s primary years. In 2007, the family moved their business to South Yaamba to be closer to High Schools for their children. When the role of Accounts Assistant became available at Grant & Simpson, Shelley welcomed the opportunity to get back into the work she loved. She took over the reins of the firm’s busy Accounts Department in 2010 and provides vital support to the Partners, staff, and clients.

Shelley is happy to assist with any billing queries you may have.

Outside of work Shelley loves spending time with her family and pursuing her sporting interests including rowing and ocean swimming.

SERVICE SPOTLIGHT | EMPLOYMENT LAW

The Queensland Industrial Relations Act 1999 sets out the minimum standards or obligations of employment. Where the employer is a corporation, the Commonwealth or a waterside, maritime or flight crew entity then the Commonwealth Workplace Relations Amendment (Work Choices) Act 2005 now overrides the Queensland Act. Different industries or different businesses within those industries may have their own Industrial Award or Contract of Employment or Certified or Workplace Agreement, but they usually cannot offer less than the minimum provision set out in the Industrial Relations Act.

Formal agreements can now be put in place under the Commonwealth Workplace Relations Amendment (Work Choices) Act of 2005 as an alternative to an award.

It is recommended that you seek advice from Grant & Simpson Lawyers if you are an employer considered dismissing an employee to ensure that you follow the correct procedure to avoid an action for wrongful dismissal. Alternatively, if you are an employee we can advise you in respect of your rights to avoid dismissal or to enable an action for re-employment or compensation.

MEET THE TEAM | ANJANETTE DOYLE

In 2019 the Partners at Grant & Simpson purchased the files and safe custody documents of Connolly, Schirmer & Batts Solicitors upon the retirement of the Principal, Allan Batts and subsequent closure of his office.

At this time Grant & Simpson were fortunate enough to also acquire the services of Anjanette Doyle. Anjanette had been with Connolly, Schirmer & Batts for approximately twenty-three years and in February 2020 was admitted as a Solicitor of the Supreme Court, Queensland.

Anjanette works in the areas of Conveyancing, Estate Administration, and Wills and Enduring Powers of Attorney.

Away from the office Anjanette spends her time with family and friends.
