UPDATED 2026 DEFINITION OF A ‘SIMPLE WILL’

for prospective will clients:

A simple will does not involve the following scenarios:

1. No remote witnessing
2. No family trust
3. No family company
4. No self-managed super fund
5. Property subject to a joint tenancy – in this case Property Law overrides Succession Law and the property goes to the surviving joint tenant. If the property is held in a single name or as a joint tenant, a testator can then leave their property or their share to a beneficiary.
6. Testator should perform title searches of all properties included in the estate or be able to provide copies of current certificates of title. Title particulars and addresses must be included in wills.
7. Property owned in the name of a company – Director does not have the power to transfer property to a beneficiary
8. Superannuation is often a non-estate asset and is determined by the Superannuation trust deed – these trust deeds are complex and do not fit within the definition of a simple will. In most cases the testator must liaise with their superannuation provider and ascertain whether they can make a binding nomination. We have no involvement with non-estate assets. Binding nominations generally need to be renewed at specific intervals determined by the superannuation provider.
9. Testator must be able to read & write & speak English - otherwise additional fees apply as a special ‘attestation’ clause must be drafted & included in the will- an interpreter must be engaged & affidavits of attestation must be drafted and signed by the interpreter & 2 witnesses to the will
10. A family member/ friend cannot interpret for a testator. The testator must engage the services of a NAATI interpreter and is at all times responsible for their fees.
11. Testator must be able to see – otherwise a special “attestation” clause is required
12. If I am on annual leave/otherwise engaged, I cannot accept instructions. Clients must instruct elsewhere.
13. Urgency fees apply for “deathbed wills”, urgent hospital visits, urgent attendances at home or at care/respite facilities
14. Additional call out fees apply to visiting clients in hospitals, homes & care/respite facilities – fees are based on distance from office
15. Testator cannot be classified as a “vulnerable person” – i.e. very elderly or has a disability or there is a history of domestic violence or elder abuse.
16. Testator does not have the required mental or physical capacity to sign a will In the case of mental incapacity we cannot act as the testator cannot make a valid will. All testators must be able to answer the following questions:
• Who are your family members
• What are your assets and liabilities
• Who do you want to leave your asset to
• Why do you want to leave your asset to a particular person/entity- why have you chosen to do it that way
• Do you have an existing will & where is it
• Have you been diagnosed that your capacity has been compromised
17. If client requires more than 1 set of amendments to the will then additional fees apply or has more than 6 beneficiaries then additional fees apply or requires more than 1 certified copy of the will
18. Testators must disclose assets and liabilities – especially if an asset is held overseas as Australian wills do not apply to overseas assets and liabilities – require a separate will overseas.
19. Testators must disclose if a beneficiary is a bankrupt as Bankrupts are accountable to the Trustee for Bankruptcy. Prior to distribution of an estate, a bankruptcy search should be performed.

In all the situations above, additional fees apply or
we can decline to act.

The NSW Labor Government is trying to pass a bill to effectively eliminate workers compensation psych claims which are on the increase. Psychological claims are on the increase BECAUSE of bullying in the workplace. Instead of directing attention to developing strategies to reduce bullying in the workplace, the government is stopping people in the workplace from claiming for legitimate injuries backed by medical experts in the field. THIS is the government's solution to the problem.

CONVEYANCING MATTERS

Changes to the Foreign Resident Capital Gains Withholding (FRCGW) regime will apply to all contracts to sell property entered into on and after 1 January 2025.

Under the changes:
- The withholding rate increases from 12.5% to 15% of the sale price

- The $750,000 property value threshold is removed and the withholding rules will apply to all property sales.

If you are acting for the vendor you will need to:
- Apply for a clearance certificate irrespective of the value of the property and

- Provide it to the purchaser at or before settlement.

If you are acting for the purchaser and the vendor does not provide a clearance certificate by settlement, then irrespective of the value of the property 15% of the sale price must be withheld by the purchaser and paid to the ATO.

RISK ALERT FROM LAWCOVER

‘Tis the season for scams

Criminals targeting law practices are especially active over the holiday season.
We have seen a spike in payment redirection fraud by email as well as an increase in criminals calling solicitors and impersonating their bank.

Solicitors are receiving calls from someone purporting to be from the bank, stating that there has been suspicious activity and that the law practice’s office and/or trust account needs to be suspended. The person calling seems credible, has some knowledge of the practice’s accounts, and in some instances provides an email address which appears to be a bank email address. The solicitor is told that in order to restore access to the accounts they need the practice’s security code, which, if provided, is then used by the criminal to transfer money out of the accounts.

Tips for staying safe:

- If you receive an email, phone call or message from someone who says they are from your bank, ask for a reference number and then contact your bank directly using a phone number that you find and confirm yourself.


- Hang up if you receive a call from someone claiming to be from your bank requesting your online banking password, one-time security code, PIN or token.


- Do not click on links in an email or text message, even if it looks like it comes from your bank.


And of course:
- Always call to confirm emailed bank account details before transferring funds. Do not use the phone number in the email.

The good news is that many of the fraud attempts have failed because the client or practice has called to verify emailed bank account details before transferring funds.

Before making a payment based on emailed details:

STOP
Never rely on emailed bank account details

DOUBLE CHECK
Always check details in person or by phone
- Make an outbound call
- Use a known phone number (not the one on the email)
- Be sure you know the person you are speaking to
- Check the account details

Warn clients and other payers to do the same

To avoid disappointment we suggest that you contact the office on 02 9584 1532 to make an appointment or arrange a teleconference prior to turning up. As a professional legal practice, we operate 'by appointment only'. If you do turn up without an appointment, please understand that we may not be able to devote the time to you that you require and will arrange for you to come back later or organise a teleconference.
This office is open M - F from 9am to 5pm. The Practice closes between 1-2pm on weekdays. There is always a contact number placed on the door if we have been called away from the office. Alternatively, you can always leave a telephone message or speak to our law clerks in the office.

Hazardous traffic intersection - Belmore Rd & Webb St Riverwood NSW 2210

Georges River Council's response:
Thanks for your email and raising concerns regarding pedestrian safety at the intersection - Belmore Rd & Webb St Riverwood.

Georges River Council has successfully secured grant funding from Transport for New South Wales (TfNSW) through the NSW Safe Speeds in High Pedestrian Activity and Local Areas to undertake the traffic facilities project in Riverwood to convert the area into a ‘High Pedestrian Activity Area’ (HPAA).

The Riverwood High Pedestrian Activity Area (HPAA) project is focused on improving the pedestrian activity within the town centre involving the installation of approximately 35 varying types of traffic facilities across Riverwood. The varying traffic facilities include gateway treatments, pedestrian crossings, continuous footpath treatments, raised thresholds, traffic signals upgrade, and the upgrade of pedestrian facilities along Belmore Road and adjacent side streets through coordinated public domain interventions.

As part of Riverwood HPAA project, the intersection - Belmore Rd & Webb St traffic signal will be upgraded to include pedestrian protection for all signal phases. TfNSW is currently working on to upgrade this intersection. Once the project has been completed, this intersection will meet the current standard and improve pedestrian safety.

NB: In a further email from Council pparently red light arrows being installed in approx August 2024.

Cyber Alert: Cyber criminals targeting legal transactions
Lawcover has seen an increase in the amount of cyber attacks targeted at law practices.

Methods of attack
- Clients transferring funds to criminals believing they are putting money into solicitors’ trust accounts
- Fraudulent calls from the solicitor’s bank (impersonating bank staff), leading to theft from trust accounts.

HOW TO DEFEND YOURSELF:
Clients must telephone to check bank account details
For large transactions, clients can make small “test” payments and telephone our office to confirm receipt.
