In this edition of our case notes, our principal solicitor Chen Yang instructed in the first Judge Alone Trial in the Supreme Court of Victoria in the state’s history, as well as the first Trial in the Supreme Court to be conducted entirely online.

At the completion of this Trial, our client was acquitted of Murder and found guilty on the lesser charge of Manslaughter.

The impact of the COVID-19 pandemic on the Victorian criminal justice system has been significant, with new charges introduced to enforce public health restrictions.

In this case our managing solicitor Kyle McLaughlin secured an outcome of Diversion for our client who was charged with breaching the Chief Health Officer's Stay at Home Directions.

This was a great result for our client, as they will not have a criminal record.

In this edition of our series covering the impact of the COVID-19 Pandemic on the Victorian Courts, our senior solicitor Michael Cunningham utilised the County Court's Emergency Case Management Protocol and secured a plea offer which resulted in many serious charges against our client being withdrawn.

Due to COVID-19 restrictions on the operations of the courts, two trial listings for this matter were vacated. This plea offer was not only advantageous for our client, but also meant a lengthy delay awaiting a third trial listing could be avoided.

Quick Facts Our client faced several serious charges relating to two incidents of family violence. The most serious of these charges were two counts of Aggravated Burglary, contrary to s 77 of the Crimes Act 1958.
