Charged with a summary offence and don’t know what to do?

A summary offence is defined in Section 3 of the Criminal Procedure Act 1986 (NSW) as an “offence that is not an indictable offence”. A summary offence includes any minor criminal offence that the local courts of NSW can deal with. Typically, the maximum penalty of a summary offence is two years imprisonment. Many summary offences carry a fine only. Some examples of a summary offence include using offensive language, offensive conduct, failing to leave a licensed premises, and minor drug offences.
