๐ŸŒŸ **A Proud Win for Nadeem Lawyers** ๐ŸŒŸ

We are pleased to share a significant outcome for one of our client families. After a long and challenging journey, the Administrative Review Tribunal has **set aside the refusal** of their protection visas.

The Tribunal accepted the serious risks our clients face in India due to their **interfaith marriage** and **religious conversion**, and has **remitted the matter for reconsideration**.

This result reflects our commitment to thorough preparation, strong advocacy, and standing with clients when it matters most.

๐Ÿ™ Congratulations to our clients โ€” and thank you for trusting Nadeem Lawyers with your case.

New Skills in Demand (subclass 482) Visa, Australia expands pathways for Skilled Workers:

The Skills in Demand visa is replacing the Temporary Skill Shortage (subclass 482) Visa from December 7, 2024. This new visa features a three-tiered system based on annual earnings and occupation. Here's a breakdown of the requirements:

Specialist Skills Pathway:

- Guaranteed annual earnings of at least $135,000 (indexed annually)
- Priority processing with a 7-day median visa processing time
- No occupation list applicable, but excludes trades workers, machine operators, drivers, and laborers

Core Skills Pathway:
- Guaranteed annual earnings of at least $73,150 (indexed annually)
- A simpler and regularly updated Core Skills Occupation list (CSOL) managed by Jobs and Skills Australia

Essential Skills Pathway:

- For occupations earning under $73,150 per year but working in essential skill occupations
- Further assessment by the government is being undertaken on the best way to introduce this pathway

Other key elements of the Skills in Demand visa include:

- Time spent with any approved employer will count towards permanent residence requirements
- Visa holders will have access to self-nominated independent permanent pathways, in addition to employer-sponsored pathways
- The visa will provide for a 4-year stay for all streams
- Median processing time of 21 days
- Streamlined labour market testing (LMT) requirements.

PATHWAYS TO PERMANENT RESIDENCY FOR SHORT TERM-STREAM FOR SUBCLASS 482 VISA HOLDERS:

From 25 November 2023, the Australian Government will be making changes to Temporary Skill Shortage (TSS) (subclass 482) and Temporary Residence Transition (TRT) stream of the Employer Nomination Scheme (ENS) (subclass 186) visas to provide a pathway to permanent residence for TSS visa holders.

Changes planned for TRT stream nomination requirements include allowing employers to nominate holders of all streams of TSS visas (including Short-term and Labour Agreement streams), removing the requirement for nominated occupations for the TRT stream to be assessed against a skilled migration occupation list. The nominated occupation will need to be listed in the Australian and New Zealand Standard Classification of Occupations (ANZSCO) and the nominated worker will need to continue to work in the occupation nominated for their TSS visa(s) and reducing the period of time a TSS visa holder must hold their visa and work in their nominated position or occupation to be eligible to be nominated by their employer for the TRT stream to two out of the three years before nomination.

Changes to the TRT stream nomination requirements are intended to apply to new ENS nomination applications and applications that are yet to be finally determined as at 25 November 2023.

REMOVAL OF LIMIT ON NUMBER OF SHORT TERM-STREAM SUBCLASS 482 VISA APPLICATIONS IN AUSTRALIA:

Australian Government has recently announced that from 25 November 2023, it will remove the limit on the number of short-term subclass 482 visa applications that a visa holder can make in Australia.

This change is intended to apply to new short term-stream 482 visa applications made on or after 25 November 2023. The short term-stream 482 visa holders with visas expiring before 25 November 2023 will need to travel outside Australia to lodge a third short term-stream 482 application.
