🚨 The Fair Work Commission is Regulating AI. ⚖️🤖

If you’re an employer or an employee, the rules for filing claims in the Fair Work Commission (FWC) just changed. With AI-driven claims surging by over 70%, the Commission has officially stepped in to manage the "hallucinations" and fabricated facts being submitted to the tribunal.

What you need to know:
Starting now, it is no longer enough to just "hit submit." New procedural rules mean:

✅ Mandatory AI Declaration: You must explicitly disclose if Generative AI (like ChatGPT) was used to prepare your documents.
✅ Personal Verification: Applicants must now sign a declaration confirming they have personally verified every fact, quote, and legal case cited.
✅ Hyperlink Requirements: Lawyers and agents are now required to provide working hyperlinks for all cited case law to prevent "fake" AI-generated citations.

⚠️ The Consequences are Real:
The FWC is no longer just a "no-costs" jurisdiction when it comes to AI misuse. If a claim is found to be misleading or lacks reasonable prospects due to AI errors, the Commissioner can:

🚫 Dismiss the case immediately.
💰 Order you to pay the other party’s legal costs.
❌ Disregard your evidence entirely.

The Bottom Line: AI can be a great drafting assistant, but it is not a lawyer. If the AI "hallucinates" a fact, you are the one held legally liable.

A landmark result for fairness in harness racing.

After more than 14 years away from the sport, champion harness driver Greg Bennett has been cleared to return to racing following a successful appeal before the Queensland Civil and Administrative Tribunal (QCAT).

Hammond Nguyen Turnbull was proud to act in this significant matter, with our Special Counsel Peter Morris instructing Mr Murdoch KC for the Applicant.

The Tribunal carefully reviewed the long history of the case and ultimately found that Mr Bennett is a fit and proper person to hold a Harness Racing Grade A Driver Licence. In doing so, it set aside the earlier refusal by the Queensland Racing Integrity Commission.

This decision is important not only for Mr Bennett, but for the industry more broadly. It reinforces that licensing decisions must be based on reliable evidence, proper process, and procedural fairness — particularly where a person’s livelihood and reputation are at stake.

We are proud to have supported this long-fought outcome and to continue assisting participants across the racing industry in integrity, licensing and disciplinary matters.
