Is mediation legally binding?

The short answer is NO. But it is a legal requirement to attempt mediation after separation.

If you want to you can have a lawyer present, but this is not compulsory.

If an agreement is reached at mediation, you can then see a lawyer if you need it drafted legally, this can save you time and MONEY.

Did you know you can have a lawyer participate in the mediation with you?

If you choose to do so, your lawyer can be present in the mediation. All of our team of highly trained mediators are happy for you to have a lawyer present or not, it's entirely up to you.

Our mediators can't give legal advice, hence if an agreement is reached and you need it drafted into a legal document, we will always refer you back to your family lawyer to assist with the legal drafting process.

In many cases, especially where children are involved, parties exit mediation with an agreed plan and don't require lawyers. These issues and agreements can all be discussed during the mediation process to see what works best for both parties (and your family).
