In NSW (and most Australian states), a sibling does not automatically have a right to claim on an estate. A sibling may be able to make a family provision claim if they can show:

๐Ÿ”น The deceased failed to make adequate provision for their proper maintenance, education or advancement in life.

Family trust
๐Ÿ”น Set up during your lifetime
๐Ÿ”น Commonly used for asset protection, tax planning and business structuring
๐Ÿ”น Operates under a trust deed
๐Ÿ”น Assets generally do not form part of your estate on death
๐Ÿ”น Control passes according to the deed (often via an appointor)

Testamentary trust
๐Ÿ”น Created by your Will and only starts after death
๐Ÿ”น Used to control how inheritance is managed for beneficiaries
๐Ÿ”น Common benefits include tax flexibility, asset protection and protection for vulnerable beneficiaries
