**Important changes coming into effect on 1 January 2025**

Legislation changing the current Foreign Resident Capital Gains Withholding received assent on 10 December 2024 and the changes will apply to all Contracts entered on or after 1 January 2025.

From that date, the threshold is abolished and ALL Australian residents selling property will require a Clearance Certificate (currently only required by those selling $750,000 and above). If a vendor does not provide the purchaser with a Clearance Certificate by settlement, 15% of the sale price will be withheld by the purchaser and paid to the ATO...
