The Federal Court has found that aspects of Coles' "Down Down" campaign were misleading after some products were temporarily increased in price before later being promoted as discounted.

In a time when many Australians are carefully watching every dollar at the checkout, the case highlights an important consumer protection principle:

The Court found that shoppers were sometimes presented with the impression of savings when the promotional price was still the same as, or higher than, an earlier regular price.
