Many people believe or assume that they don’t need a Will, a Power of Attorney or Enduring Guardian…

… particularly if they are married or have children, on the understanding that whatever assets they own will automatically pass to their intended beneficiaries when they die or that the power to make medical and health/lifestyle decisions for them if they become incapacitated automatically lies with their family members.

That is not the case – for example: unless you have executed a valid power of attorney, there is no authority for anyone to access your bank accounts (if held in your sole name) if you become incapacitated and require assistance managing your financial affairs. If you no longer have capacity, an application to a Tribunal (NCAT) on your behalf would be required.

On 11 October 2021 it became compulsory that all transactions involving land in NSW are now to be conducted electronically.

This also means no more paper Certificates of Title 📃

What does this mean for your CT?

Paper titles are no longer legal documents.

If or when you pay off your mortgage (or if there is no mortgage when you purchase a property) you will no longer receive a paper CT.

Instead an “Information Notice” will be issued.

When dealing with property, the information on the Torrens Title Register (confirmed by an up to date title search) is to be relied upon.
